The Project consists of sidewalk extension and crosswalks along State Trunk Highway (S.T.H.) ‘130’ ’133’. Bids will be received for a single prime Contract. Bids shall be on a lump sum and unit price basis, with additive alternate bid items as indicated in the Bid Form. The work is subject to the provisions of Sections 61.54, 62.15, 66.0901, and 66.0903(1m) of the Wisconsin Statutes. A portion of this Project is funded in part with funds from the Wisconsin Department of Transportation’s (WisDOT) Transportation Alternatives Program. Conformance with WisDOT’s Buy America Certification is required. Minimum salaries and fringes to be paid on the Project shall be in accordance with the prevailing wage rate determination established by the Federal Department of Labor (DOL). Bidders are particularly called to the requirements as to conditions of employment to be observed and minimum wage rates to be paid under contract, Section 3, Segregated Facility, Section 109 and E.O. 11246. Not less than the minimum salaries and fringes set forth in the Contract Documents must be paid, and the Contractor must ensure that employees and applications for employment are not discriminated against because of their race, color, religion, sex, national origin, or other protected class. Federal Labor Standards program laws, including the Davis-Bacon Act, the Copeland Anti-Kickback Act, and the Contract Work Hours and Safety Standards Act, will apply. Minority-owned Business Enterprises (MBE’s), Women’s Business Enterprises (WBE’s), Disadvantaged Business Enterprises (DBE’s), and Small Businesses in Rural Areas (SBRA’s) are encouraged to submit bids. A good faith effort to achieve a combined minimum goal of participation for MBE WBE utilization in accordance with s.NR 162.09(3), Wis. Admin. Code is required. If a subcontractor awards subcontracts, these requirements shall apply to the subcontractor. No proposal will be accepted unless accompanied by a certified check or bid bond equal to at least five percent (5%) of the amount bid, payable to the OWNER as a guarantee that, if the bid is accepted, the Bidder will execute and file the proper contract and bond within 15 days after the award of the contract. The OWNER reserves the right to increase or decrease the quantity of any item or portion of the work, or to omit portions of the work, as may be deemed necessary by the OWNER. The OWNER reserves the right to waive any informalities, or to reject any or all bids, or any part of a bid, and to award the Contract to the Bidder, who in the judgment of the OWNER, will best serve the interest of the OWNER.
