The Bureau of Land Management (BLM) has determined that 280 acres of public land in Graham County, Arizona, are suitable for conveyance to the City of Safford under the Recreation and Public Purposes (R&PP) Act. The land is intended to be used by the city to expand its landfill for solid waste disposal purposes, including the disposal of small quantities of commercial hazardous waste and household hazardous waste as defined by applicable federal regulations. Future land uses should not penetrate the liner or final cover of the landfill unless excavation is conducted in accordance with applicable State and Federal requirements. The patent of the land, when issued, will be subject to several terms and conditions, including reservation of rights-of-way for ditches and canals, reservation of all minerals to the United States, indemnification of the United States from claims arising from the use or occupancy of the land, and other terms the authorized officer may determine necessary. Interested parties may submit comments on the suitability of the land for solid waste disposal, the proposed use, or whether the BLM followed proper administrative procedures in reaching its decision. Comments should address whether the land is physically suited for landfill expansion, whether the use will maximize future uses of the land, consistency with local planning and zoning, and consistency with state and federal programs. Additional terms and reservations may be added as deemed appropriate by the authorized officer.
