Each bid shall be accompanied by a bid security of not less than five (5%) percent of the total bid amount as provided in the Instructions to Bidders. The successful lowest responsive and responsible Bidder shall be required to furnish the Owner with a performance bond for 100% of the Contract Sum prior to the issuance of a contract to perform the work. No bid may be withdrawn for a period of 45 days after receipt of bids. Time is of the essence for completion of the Project. The Bidder agrees to commence work under the contract no later than the date indicated in the Owners written Notice to Proceed. The work of the contract shall be substantially completed within 90 calendar days from the Notice to Proceed; provided, however, that if the Owner elects to accept the alternates described in the Bid Documents, the work of the contract shall be substantially completed within 120 calendar days from the Notice to Proceed. It is hereby further stipulated that the Professional of Record receives hourly compensation as indicated in the Owner/Architect Agreement for continued contract administration for the Project.
