Generally, the Work covered by the Plans and Specifications consists of the material, labor, tools, and equipment required for the removal and replacement of existing gate valves. The work includes the following approximate principal quantities: Remove & Replace 6" Gate Valve & Box (Complete) - 9 EA, , Street Repairs at Replaced Gate Valves - 1 L SUM, and all necessary restoration required as depicted in the Drawings and Project Manual for the Project All Bids are to be submitted on the basis of cash payment for the Work and Materials necessary to complete the project. Each bid must be accompanied by a separate envelope containing the contractor's North Dakota license and bid security. The bid security must be in a sum equal to five percent of the full amount of the bid and must be in the form of a bidder's bond. A bidder's bond must be executed by the bidder as principal and by a surety, conditioned that if the principal's bid is accepted and the contract awarded to the principal, the principal, within ten days after notice of the award, shall execute a contract in accordance with the terms of the bid and the bid bond and any condition of the governing body. A countersignature of a bid bond is not required under this section. If a successful bidder does not execute a contract within the ten days allowed, the bidder's bond must be forfeited to the Owner and the project awarded to the next lowest responsible bidder. Bidders must be licensed in the class within which the full amount of the bid falls as required by section 43-07-12 of the North Dakota Century Code. This project is being financed in part with funds from the Community Development Block Grant (CDBG) Program. Bidders on this work will be required to comply with all applicable federal laws, regulations, and executive orders, including but not limited to the President's Executive Order No. 11246 (as amended), the Davis-Bacon and Related Acts, the Copeland "Anti-Kickback" Act, and the Contract Work Hours and Safety Standards Act. The requirements for bidders and contractors are addressed in further detail in the specifications. No Bid may be read or considered if it does not fully comply with the requirements of this advertisement or applicable law. Any deficient Bid received will be resealed and returned to the Bidder immediately. The Owner reserves the right to hold all Bids for 45 days, to reject any or all Bids, and to waive any informality or irregularity in any Bid and to accept the Bid deemed in the best interest of the Owner and to rebid the project until a satisfactory bid is received. There shall be endorsed upon the outside of the envelope containing the Bid, the following: 1. "City of Upham, Gate Valve Replacement Project" 2. The date of the proposal 3. The name of the person, firm, corporation, or joint venture submitting the Bid. 4. The Bidder's Contractor's License or Contractor's License Renewal Number. 5. Acknowledgement of Addendum, if any. All Work shall be substantially completed by November 13th, 2026. Potential bidders may contact Ackerman-Estvold at (701) 837-8737 with any questions. Should the Contractor fail to complete its obligations under the Contract Documents within the time required herein or within such extra time as may have been granted by formal extensions of time approved by the Owner, there will be deducted from any amount due to the Contractor the sum of $500 per day for each and every calendar day that the completion of the Work is delayed. The Contractor and its Surety will be liable for any excess. Such payment will be as and for liquidated damages and not as a penalty. By order of the City Council of Upham, North Dakota.
