The Corporation of the Municipality of Thames Centre is soliciting Tenders from qualified contractors for the Major Municipal Drain. Question Deadline 07/02/2026 at 12:00 PM ET Tender enquiries are to be submitted only through the Bidding System Documents can be obtained from https://middlesex.bidsandtenders.ca/ The Contractor shall provide and perform all labour, supervision, project management, materials, equipment, tools, machinery, transportation, mobilization, demobilization, utility coordination, testing, inspections, warranties, incidentals, services, and all other resources necessary to properly perform and complete the Work in accordance with the Contract Documents. 4.2 Without limiting the generality of Section 4.1, the Work includes all clearing, brushing, mulching, utility locating, utility coordination, excavation, trenching, bedding, supply and installation of drainage infrastructure, catch basins, ditch inlet structures, outlet works, berm construction, riprap installation, geotextile filter material installation, tile connections, backfilling, topsoil stripping and replacement, restoration, erosion and sediment control measures, testing, inspections, deficiency correction work, warranty work, settlement repairs, and all other work contemplated by the Contract Documents necessary to complete the Major Municipal Drain Project. 4.3 The Contractor shall perform the Work strictly in accordance with the Contract Documents, all applicable laws, regulations, permits, approvals, standards, specifications, codes, utility requirements, occupational health and safety requirements, and generally accepted construction practices applicable to the Work. 4.4 All materials incorporated into the Work shall be new, free from defect, suitable for their intended purpose, and shall conform to the requirements of the Contract Documents unless otherwise approved in writing by the Municipality or the Administrator. 4.5 The Contractor shall be fully responsible for the acts, omissions, defaults, negligence, workmanship, performance, and compliance of its employees, subcontractors, suppliers, consultants, agents, and any other persons engaged by or through the Contractor in connection with the Work. 4.6 The Contractor acknowledges and agrees that it has reviewed the Contract Documents, inspected the Project site, satisfied itself as to site conditions, access requirements, working area requirements, utility locations, operational constraints, landowner considerations, working conditions, and all visible and reasonably inferable circumstances affecting the Work to the extent contemplated by the Contract Documents, and has included within the Contract Price all labour materials, equipment, contingencies, and costs necessary to achieve Total Performance in accordance with the Contract Documents. 4.7 The Contractor shall be responsible for delivering a complete, operational, functional, fully tested, fully compliant, and fully warranted drainage system suitable for its intended purpose. The Contractor shall provide and perform all labour, materials, equipment, services, and incidental work reasonably necessary or reasonably inferable to achieve Total Performance notwithstanding that every such item may not be expressly described within the Contract Documents. 4.8 The Contractor shall coordinate its Work with the Municipality, the Administrator, utility providers, affected landowners, agencies having jurisdiction, and all other persons identified within the Contract Documents to the extent required by the Contract Documents. 4.9 The Contractor shall not replace, remove, or substitute any subcontractor identified within the accepted Tender Submission without the prior written approval of the Municipality or the Administrator. 4.10 The Contractor acknowledges and agrees that the Contract Price includes all costs necessary to achieve Total Performance in accordance with the Contract Documents except only those items expressly identified as Provisional Items, extra work, quantity adjustments, or other authorized adjustments and approved in accordance with the Contract Documents. 4.11 For greater certainty, the Contractor shall be responsible for all work reasonably necessary or reasonably inferable for the proper completion of the Project notwithstanding that every labour item, material item, component, service, operation, or activity required to complete the Work may not be expressly described in the Contract Documents.
