Bids submitted in excess of $ 10,000 without proper bonding requirements will be found non-responsive and disqualified from consideration. In the event that the bidder cannot satisfy the bid after Cleveland Metroparks awards the bid, the award will be given to the next qualified successive bidder as identified by Cleveland Metroparks and the difference in cost and all related costs to the difference will be assumed by the original bidder and/or its surety. The deposit or bond of the successful bidder will be retained until the contract is properly executed and delivered. Bid guaranties of all unsuccessful bidders will be held until a proper contract is entered into or until all bids are rejected, as the case may be, and will be returned immediately thereafter. The successful bidder shall be required to file, at the time a contract is entered into, a Performance and Labor and Materialman Bond written on an acceptable surety company authorized to do business in the State of Ohio and in an amount equal to 100% of the contract price. Bidder shall be certified by the Ohio Department of Transportation as a Prequalified Contractor for Worktype 45, Pavement Markings, and shall submit said documentation with the bid. Bidder shall furnish all materials, labor, supervision, and equipment necessary to perform the work defined herein. Work shall be governed by the requirements of Ohio Department of Transportation Construction Materials and Specifications (CMS) and the Ohio Manual of Uniform Traffic Control Devices (OMUTCD). Contractor shall safely maintain traffic continuously through work zones by means of flaggers, off-duty Police and/or appropriate standard control measures specified in CMS 614.
