The Project generally includes construction of a new well and well house with associated site piping, installation of a new service pump in an existing pump room, electrical and SCADA improvements, and related site work. No bid bond or certified check is required with the initial proposal. The Town reserves the right to reject any or all responses, waive immaterial irregularities, request clarification, terminate the process, and exercise its discretion in accordance with IC 5-23 and other applicable law. In accordance with Indiana Code 5-23, the Town of Chandler (the "Town") is issuing this Request for Proposals and Qualifications (the "RFPQ") seeking proposals and statements of qualifications from responsible offerors for a public-private Build-Operate-Transfer Agreement (the "BOT Agreement") concerning upgrades at the Town's water treatment facility (the "Project"). The Chandler Town Council (the "Council") will serve as the board for purposes of IC 5-23 . The Council may designate an advisory evaluation committee (the "Evaluation Committee") and other authorized Town representatives, including the Town's engineer and legal counsel, to review proposals, conduct discussions, negotiate best and final offers, and prepare a recommendation. The Council retains authority over any final award. The Evaluation Committee will conduct its work and maintain records as required by applicable law. The technical scope and other available Project materials included in the Plan Room are part of this RFPQ. The Town may clarify or supplement those materials by addendum. The Town has engaged Egis BLN USA (the "Engineer") under a separate professional-services procurement to serve as the engineer of record. The successful offeror will provide development and design-assist services, including constructability review, value engineering, budgeting, scheduling, procurement planning, and coordination with the Town and Engineer. Offerors should not propose a separate engineer of record. Any specialty or delegated design required for construction means and methods, temporary works, equipment, or particular systems must be performed by properly licensed professionals and coordinated with the Engineer
