The Town of Acton is currently seeking sealed bids for a 3-year contract for District 1, North Side Winter Maintenance. Performance Bond. In lieu of a performance bond, the Contractor agrees to have ten percent (10%) withheld from each monthly payment. The purpose of the ten percent (10%) withholding is to make funds available to the Town in the event the Contractor does not complete part or all of the duties under this Agreement. The funds will be used to complete any work that the Contractor fails to do. Payment of this ten percent (10%) withholding or any amount remaining will be paid in accordance with the attached Payment Schedule (Exhibit B). The Contractor shall be responsible for ensuring that persons providing services under this Agreement have a valid driver's license with the proper classifications. The Select Board reserves the right to reject any and all bids for cause
