The bidder proposes that the Instruction to Bidders, Purchase Order Terms and Conditions, General Requirements and Covenants, Plans and Specifications, shall form and be part of the Purchase Order/Contract Agreement to be signed by the bidder if this Proposal is accepted, and if the amount of the Contract exceeds $150,000, the bidder will furnish a Performance and Payment Bond in a form acceptable to the Director, in a penal sum equal to 100% of the estimated Contract price with Surety or Sureties satisfactory to the Director, to guarantee the completion of the work and also to guarantee that all material and labor on this work, or incidental to the completion of this work, will be fully paid for by the Contractor or his Surety.
