A certified check or bank draft payable to the Locality or negotiable U.S. Government Bonds (as par value) may be submitted in lieu of the Bid Bond. A 100% Performance Bond is required on all the contracts in excess of $100,000. A 100% Payment Bond is required on all contracts in excess of $50,000. If the contract is less than $100,000, the OWNER may hold all payment until final completion in lieu of the Performance Bond. If the contract is less than $50,000, the OWNER may also choose to waive the Payment Bond. A 100% Maintenance Bond is required on all contracts. Such bonds must be issued by a corporate surety authorized to do business in the State of Texas. Bidder understands that the OWNER reserves the right to reject any or all bids and to waive any informalities in the bidding. Bidder also understands that the OWNER reserves the right to award the contract to the lowest responsive, responsible bidder according to the base bid amount or any of the alternate bid amounts.
