In accordance with RCW 39.10.380, Contractor (General Contractor/ Construction Manager) is requesting sealed proposals from contractors for the above referenced scopes of work. The project is to complete ESC HVAC/Lighting/Roof Upgrade Project. In accordance with RCW 39.10, all base bids submitted at or over three hundred thousand ($300,000) must include either a bid security or cashier's check made payable to GC/CM in the amount of 5% of the Base Bid shall be submitted with each Bid Package. This Bid Bond shall serve as evidence of good faith and as a guarantee that, if awarded the Contract, the bidder will execute the Contract and provide a payment and performance bond as required. The GC/CM reserves the right to hold the bid security of the three lowest bidders until the successful bidder has entered into a contract and furnished the required documents. For any bids where the base bid total is under three hundred thousand ($300,000) no bid bond or bid security is required, however, inclusion will not constitute removal or preclusion from submitting a complete bid. In accordance with RCW 39.10, all base bids submitted at or over three hundred thousand ($300,000) must be able to provide a Payment and Performance Bond (P&P) from a qualified and acceptable Surety. Bidders must submit include costs in the appropriate location of the bid form and submit evidence of P&P capabilities within five (5) days of notification of Apparent Low. Final P&P must be submitted to the GC/CM on a form acceptable to the GC/CM within ten (10) calendar days after issuance of Notice of Intent to Award Contract, exclusive of the day of notice. Failure to submit the P&P or proper forms after Apparent Low or Intent of Award may result in forfeiting the bid deposit or Bid Bond being forfeited to the Contractor, as liquidated damages but not as a penalty.
