Proposals may be mailed AND RETURN RECEIPT is required or delivered by messenger. However, it is the bidder's responsibility alone to ensure delivery of the proposal to the hands of the CITY'S Purchasing Officials prior to the bid opening hour stipulated in the Notice Inviting Sealed Bids. Late proposals will not be considered and are automatically disqualified. Bidders must hold a valid California Class A Contractor's License. For fabrication of metal units, Class C43 license is permissible. No bid will be accepted from a Contractor who has not been licensed in accordance with provisions of the Business and Professions Code. The successful Contractor and his subcontractors will be required to possess business licenses from the City. The CITY will deduct five percent (5%) retention from all progress payments as specified in Section 9-3.2 of these Specifications. The Contractor may substitute an escrow holder surety of equal value to the retention and the Contractor shall be beneficial owner of the surety and shall receive any interest thereon. The CITY reserves the right to reject any or all bids, to waive any irregularity and to take all bids, under advisement for a period of sixty (60) days. The contract period for this project will be based on two (2) phases of work: 1. Measurement and Fabrication Phase - Seventy (70) Calendar Days 2. Installation Phase - Twenty (20) Calendar Days. Upon execution of the contract agreement between the City and successful bidder, the City shall issue a Notice to Proceed for the Measurement and Fabrication Phase of this project. The Measurement and Fabrication Phase of this project shall be completed within seventy (70) calendar days from Notice to Proceed. The contract period for the installation phase of this project shall be twenty (20) calendar days from the effective date of the Notice-to-Proceed for construction to be issued by the City. This Notice shall be issued by the City immediately following delivery of the fabricated units.
