The Corporate Town of Argos ("Argos") owns real property commonly known as the Maple Grove Cemetery ("Cemetery"), located on the west side of Juniper Road, between State Road 10 and 16th Road. The Cemetery is governed by the Maple Grove Cemetery Board ("Board"). The Cemetery totals 10 acres (more or less). The Board desires to secure the services of lawn mowing and general grounds maintenance for the Cemetery,
and shall receive bids for the same under the terms and specifications set forth below.
o The term of the mowing contract shall be for a period from April 15, 2022 to November 1, 2022.
o All bids submitted shall be a total dollar sum for the entire term of the contract, as opposed to a dollar per mowing sum. Any bids submitted that do not state a total dollar figure shall be rejected.
oThe Board shall pay the successful bidder 25% of the successful bid amount on or before the dates of May 1, 2022, July 1, 2022, September 1, 2022 and November 1, 2022.
oLawn mowing shall include and be defined as the regular mowing, weed-eating around all trees, grave markers, signs and all other objects, and removal of all grass clippings from grave
markers, and shall include the entire Cemetery property. All work shall be done and completed in a neat and workmanlike manner. No grass or weeds shall be permitted to grow more than a height of 6 inches anywhere on the Cemetery property at any time, with the initial lawn mowing to occur not later than May 1, 2022. Additionally, regardless of grass or weed height, lawn mowing shall occur within 4 days prior to the following holidays: Mother's Day, Memorial Day, Father's Day, July 4th and Labor Day. Lawn mowing shall not take place during any memorial or
burial service occurring at the Cemetery. All flowers (real and artificial), arrangements and memorials left at gravesites shall be collected and disposed of on or before May 1, 2022 and again within 7 days of October 1, 2022. Any submitted bids are not deemed to be confidential. Questions regarding the bidding process and these terms and specifications shall be directed to the Argos Clerk-Treasurer. The successful
bidder shall execute (sign) this document upon notification from the Board as being selected as the successful bidder, and this document shall serve as the lawn mowing contract.
oThe successful bidder shall maintain during the term of this ease a policy of liability insurance of not less than a $1,000,000.00 general aggregate limit, and which names Argos and the Board as additional insureds therein. A certificate reflecting such insurance coverage shall be delivered to the Board upon request. Additionally, the successful bidder shall indemnify, defend and hold
harmless Argos and the Board against any liability, claims, damages, losses or expenses incurred by Argos or the Board in connection with any intentional or negligent acts or omissions
on the part of the successful bidder. oThe successful bidder shall not assign or transfer the rights acquired hereunder without the express written consent of the Board. All notices required herein shall be given in writing to the other party at the addresses as provided by the parties. The successful bidder shall follow and comply with all Federal, State and local laws, rules and guidelines.
o In the event of default of any of the terms and specifications as described herein on the part of the successful bidder, Argos and the Board shall have all rights and remedies as provided herein, including specifically the right to declare this contract terminated and void, in addition to any and all other rights and remedies as provided at law or in equity, including specifically the right to recover all costs and expenses including reasonable attorney fees.
