To do all the work and furnish all the necessary superintendence, labor, machinery, equipment, tools, materials and incidentals to complete all work on which he bids, having examined the plans and specifications with related documents and the sites of the proposed work. It is anticipated that the award of contract will be made at the regularly scheduled City Council Meeting at 7:00 PM on April 4, 2022. Bidders are expected to inspect the sites of the work and to inform themselves regarding all local conditions and legislation concerning the wage rate and the payment of prevailing wage. Each bidder will be required to submit with his bid a certified check, cashier's check or bid bond, in the amount of five (5%) percent of the total of the bid submitted, made payable to the City of Denver City, Texas, as a guarantee that bidder will enter into contract and execute bond and guaranty in the forms provided within ten (10) days after notice of award of contract. Bids without the required check or bid bond will not be considered. The OWNER reserves the right to reject any or all bids, to waive all technicalities and to accept the proposals they deem to be in their best interest. The time for completion of Contract Estimated Quantities shall not be later than August 31, 2022. The successful bidder must furnish Performance and Payment Bond for the total amount of the contract and a Certificate of Insurance as called for in this Agreement, within ten (10) days after being awarded the contract or the bid bond check will be retained by the OWNER as liquidated damages.
