The District is a quasi-municipal corporation and a political subdivision of the State of Colorado, organized pursuant to the Special District Act, 32- 1-101, et seq., C.R.S., as amended, for the purpose of providing certain public improvements, facilities and services to and for the use and benefit of its inhabitants and/or taxpayers. Pre-qualification Requirements: All Proposers Must Fulfill All of the Contractor Pre-qualification Requirements Specified in the Proposal Instructions. Work to be accomplished under this Project shall consist of removal and protect existing tree grates; dig, remove, and dispose of existing tree trunks, limbs, debris, etc.; expand tree pit as required to accommodate new tree ball; remove wire baskets, burlap, etc. to prepare root ball for planting; provide additional structural soil as required to backfill tree; reestablish and replace irrigation around tree as required; replace tree grate where required; and water in new tree. A Contractor will be selected for the Project using a weighted scale which evaluates several criteria. The following criteria will be among those used in evaluating Proposals: Contractors experience on similar projects, contractors performance history on previous District projects, key personnel staffing, safety record, construction cost factors, experience of sub-contractors, construction methodology, completeness of proposal, innovative and alternative proposals. PREVAILING WAGE RATE: Contracts for construction, reconstruction and remodeling are subject to the Citys prevailing wage rate requirements established pursuant to Section 20 76, of the Denver Revised Municipal Code (the D.R.M.C.). Contractor shall contact City and County of Denver Office of the Auditor for prevailing wage for this project. As its best interest may appear, the District reserves the right to reject any or all proposals and to waive informalities in or non-responsive portions of the proposal. The District may conduct such investigations as it deems necessary to assist in the evaluation of any proposal and to establish the responsibility, qualifications and financial ability of the proposer, any participants with the proposer and any proposed subcontractors, to do the Work in accordance with the Contract Documents and to the Districts satisfaction within the prescribed time. The Proposer shall cooperate as is reasonably necessary with the District in any such investigation. PREPARATION FOR SUBMISSION OF PROPOSAL: Before submitting a proposal, each proposer should: (1) examine the Contract Documents thoroughly; (2) familiarize itself with conditions that may in any manner affect cost, progress or performance, or any other aspect of the Work; (3) familiarize itself with federal, state and local laws, ordinances, rules and regulations that may in any manner affect cost, progress or performance of the Work; and (4) study and carefully correlate the proposers observations with the Contract Documents. The District is aware that it is requesting what may be considered, at least in part, proprietary or competitive-sensitive material. The Districts records are subject to the Colorado Open Records Act, 24-72-201, et seq., C.R.S. (the Act), and therefore may be open to public inspection pursuant to the Act. The District shall have no liability to the proposer for disclosure of such material to any other person for any reason. Under no circumstances shall the District be liable for any proposal preparation costs or other consequential or other damages incurred by any proposer in connection with responding to this Notice to Proposers or any act or omission taken by a proposer in reliance on this Notice to Proposers. NON-DISCRIMINATION: It is the policy of the District to prohibit discrimination in the award of construction contracts and subcontracts. Further, the District encourages contracting firms to utilize minority and women owned businesses and to divide the work into economically feasible units or segments to allow the most opportunity for subcontracting.
