The Work required for this Project includes: providing all labor, materials, and equipment necessary to complete miscellaneous earthwork, hauling and grading projects and associated tasks when requested by the Engineer on Port of Tacoma property. This is an OnCall Contract. The work will be assigned by Task Orders; each Task Order will address the scope of work and time of completion and shall be performed in accordance with the specifications and Task Order details. The Port does not guarantee a certain amount of work. Pre-Bid Conference and Site Tour: No pre-bid or site visit is scheduled for this project. Bid Security: Each Bid must be accompanied by a Bid security in an amount equal to five (5) percent of the Base Bid in a form allowed by the Instructions to Bidders. Questions will not be accepted after seven (7) days prior to the Bid Date. The Contractor shall pay (and shall ensure that all Subcontractors of any tier pay) all prevailing wages and other wages (such as Davis-Bacon Act wages) applicable to the Project. The liquidated damages, as specified and calculated herein, shall be levied, cumulatively if applicable, for each and every calendar day that Substantial Completion and/or Final Completion of the Work is delayed beyond the required completion dates, or the completion dates modified by the Port for extensions of the Contract Time. The Contractor shall achieve all interim milestones as set forth in the Execute Task Orders and Final Completion of the entire Work not later than 730 calendar days from execution of the Contract, subject to adjustments of this Contract Time as provided in the Contract Documents or until funds are depleted, whichever comes first. Port may reject Work. The Port has the authority, but not the obligation, to reject work, materials, and equipment that is defective or that otherwise does not conform to the Contract Documents, and to decide questions concerning the Contract Documents. However, the failure to so reject, or the presence of the Port at the site, shall not be construed as assurance that the Work is acceptable or being completed in compliance with the Contract Documents.
