LIQUIDATED DAMAGES: The part ies agree t hat t ime is of t he essence of t he Contract and of t he Specificat ions wherever a definit e and cert ain lengt h of t ime is fixed for t he performances of any act . A daily charge will be made against t he Contract or for each calendar day t hat any work remains uncomplet ed aft er t he elapse of contract t ime. This daily charge will be deduct ed from any money due t o t he Contract or. This deduct ion will not be considered a penalt y, but as liquidat ed damages. The liquidat ed damages set fort h is an amount , agreed t o by t he Contract or and t he Division, as reasonably represent ing addit ional proj ect construct ion administrat ion cost s incurred by t he Division and proj ect ed loss of revenue t o t he Park if t he Contract or fails t o complet e performance wit hin t he contract t ime. For t his proj ect t he Liquidated Damages will be $231 per day. The proj ect consist s of furnishing and inst alling a submersible pump, variable frequency drive (VFD), wat er met er, and associat ed electrical and piping connect ions at t he exist ing Well Number 11 at Roaring Judy St at e Fish Unit . All work shall be in compliance wit h t hese specificat ions and construct ion drawing
