The bidder to whom a contract is awarded will be required to furnish a performance bond and a labor and materials bond guaranteeing faithful performance and payment of all debts related to this contract. This is a public works project. Pursuant to Sections 1770 and 1773 of the Labor Code of the State of California, the County of Sierra has ascertained the general prevailing rate of wages applicable to the work to be done. These rates are set forth in a schedule which is on file and available in the office of the Department of Public Works, County of Sierra. Contractor shall not pay less than the prevailing rate of wages. No bid will be considered unless it is made in accordance with the provisions of the proposal requirements and conditions set forth in the Contract Documents. A Contractor or subcontractor shall not be qualified to bid on, be listed in a bid proposal, subject to the requirements of Section 4104 of the Public Contract Code or engage in the performance of any contract for public work, as defined in this chapter, unless currently registered and qualified to perform public work pursuant to Section 1725.5. It is not a violation of this section for an unregistered Contractor to submit a bid that is authorized by Section 7029.1 of the Business and Professions Code or by Section 10164 or 20103.5 of the Public Contract Code, provided the Contractor is registered to perform public work pursuant to Section 1725.5 at the time the contract is awarded. All bid protests must be in writing and received by the County Clerk before 5:00 p.m. no later than five working days following bid opening (the bid protest deadline). For purposes of this section a working day means a day that the County is open for normal business, and excludes weekends and holidays observed by the County.
