Description: The proposed work generally consists of furnishing all labor, equipment, materials, and supervision for sanitary sewer construction of approximately 1363 lineal feet of 12-inch diameter PVC pipe, along with associated manholes and service laterals. This project is subject to the state prevailing wage rates under ORS 279C.800 to 279C.870. Each bid must contain a statement as to whether the bidder is a resident bidder, as defined in ORS 279A.120. In accordance with ORS 279C.365, the City will not consider a bid unless it contains a signed statement by the bidder that they will comply with ORS 279C.838 through ORS 279C.870. All Contractors performing work on this project shall have a current, valid certificate of licensure issued by the Construction Contractor's Board in accordance with ORS 701 and, if performing work described in ORS 671.520, a current, valid certificate of licensure from the State Landscape Contractor's Board in accordance with ORS 671.560, as applicable, in place at the time the quote is presented. The City of Springfield may reject any or all bids, not in compliance with all prescribed public bidding procedures and requirements, including the requirement to demonstrate the bidder's responsibility under ORS 279C.375, or waive minor irregularities not affecting substantial rights and may reject for a good cause any or all bids upon a finding of the City of Springfield it is in the public interest to do so and accept such bids that in the opinion of the Springfield City Council are in the best interest of the City. INTENT OF PLANS AND SPECIFICATIONS The intent of the Plans and Specifications is to prescribe a complete work or improvement which the Contractor shall perform in a manner acceptable to the Engineer and in full compliance with the terms of the Contract. The Contractor shall provide the Owner with a complete and operable work or improvement, even though the Plans and Specifications may not specifically call out all items or items of work required of the Contractor to complete his tasks, incidental appurtenances, materials, and the like. The Contractor shall perform the work in accordance with the lines, grades, cross sections, and dimensions indicated on the Plans and detailed drawings. Unless otherwise specified in the Special Conditions, the Contractor shall furnish all materials, labor, tools, equipment, water, light, power, transportation, superintendence, temporary construction of every nature, and incidentals, including, but not limited to, dust and traffic control measures, and to perform all work involved in executing the Contract in a satisfactory and workmanlike manner within the time specified. 5-2 CHANGES IN THE WORK The Owner, without invalidating the Contract and without notification of Sureties, may order extra work, make changes by altering, or delete any portion of the work as specified herein, or as deemed necessary or desirable by the Owner. All such work shall be executed under the conditions of the original Contract except that any claim for extension of time and additional costs caused thereby shall be adjusted at the time of ordering such change or extra work. In giving instructions, the Engineer shall have authority to make minor changes in the work, not involving extra cost, and not inconsistent with the purposes of the work. No extra work or change shall be made unless in pursuance of a written order by the Engineer, and no claim for an addition to the total amount of the Contract shall be valid unless so ordered, except in an emergency endangering life or property. It is mutually understood that it is inherent in the nature of municipal construction that some changes in the Plans and Specifications may be necessary during the course of construction to adjust them to field conditions, and that it is of the essence of the Contract to recognize a normal and expected margin of change. The Owner shall have the right to make such changes, from time to time, in the Plans, in the character of the work, and in the termini of the project as may be necessary or desirable to insure the completion of the work in the most satisfactory manner without invalidating the Contract.
