Contract includes all work indicated in the drawings and specifications for General Contract # D005971 including but not limited to all labor, materials and equipment necessary to complete the resurfacing trails and signage installation. The Estimate Range for this project is: $638,695 - $864,118. This project is funded in part by the Recreational Trails Program, an assistance program of the U.S. Department of Transportation's Federal Highway Administration. Under 49 CFR Part 26, the U.S. DOT is committed to ensuring nondiscrimination in the award and administration of U.S. DOT-assisted contracts in highway, transit, and airport financial assistance programs through the Disadvantaged Business Enterprise (DBE) Program. RTP projects will have 0% DBE Goals, but 49 CFR 26 still applies. Any DBE participation in RTP projects must be reported to OPRHP. PUBLIC BUILDING LAW 8(6) Pursuant to Public Building Law 8(6), any contracts over $5,000 for the work of construction, reconstruction, alteration, repair, or improvement of any State building, a responsible and reliable NYS-certified Minority or Women-Owned Business Enterprise that submits a bid within ten percent of the lowest bid will be deemed the apparent low bidder provided that the bid is $1,473,245 or less (maximum amount has been adjusted for inflation effective January 1, 2022). If more than one responsible and reliable MWBE firm meets the requirements, the MWBE firm with lowest bid will be deemed the apparent low bidder. The completion date for this project is 280 Days after agreement has been approved by the NYS Comptroller's Office. Liquidated damages will apply for failing to complete the construction by May 19, 2023. The successful bidder will be required to furnish a Performance Bond and a Labor and Material Bond/Payment Bond in the statutory form of public bonds required by Sections 136 and 137 of the State Finance Law, each for 100% of the amount of the Contract.
