The bidder agrees that the check or bond submitted is the measure of liquidated damages which the School District will sustain by the failure to execute the proper agreement and bonds, and if the Bidder defaults in executing same within ten (10) days following award of contract, the check or Bid Bond shall become the property of the Wissahickon School District. Each Contractor shall provide a Performance Bond and a Labor and Material Payment Bond, each in the amount of 100% of the contract price, before the award of the contract.
