The Town of Malone is accepting sealed bids from qualified bidders for the Hauling of paving materials as follows: METHOD OF AWARD: The contract, if awarded, will be to the lowest responsible bidder who meets ail the terms of the specifications; however, the Board reserves the right to accept or reject any or all bids and to waive any informalities. Upon award, the Town will calculate the lowest responsible bidder. SPECIFICATIONS: 1.Hauling of paving materials for the summer 2023 paving season to the designated locations within the Town of Malone. 2.Bid shall include cost of delivery of Type 7F Top and Binder during the 2023 paving season with FlowBoy hauling capacity of at least 32 Ton per load. 3.Interested bidders may bid per mile, per hour or both. 4.The contract 2023 paving season will be May 1, 2023 to August 31, 2023, weather permitting. Each bid should be sealed and labeled "BID - HAULING of Paving Materials" and must include a Certificate of Non-Collusion. Women and minority owned businesses are encouraged to submit a bid. CONDITIONS: Non appropriations Clause: In accordance with NYS General Municipal Law, the Town of Malone will not be liable for any purchases or contracts for goods or services for which funding is not available. As a result, the vendor agrees to hold the Town of Malone harmless for any contracts let for which funding either does not currently exist or for which funding has been removed prior to the issuance of a purchase order by the Town of Malone. As such no contract becomes binding until the necessary funds have been approved for the fiscal year during which the contract is in effect. The Town of Malone is tax-exempt. Prices submitted shall be exclusive of Federal and State taxes and must not include any tax for which the bidder may claim exemption.
