No bids will be accepted electronically, via e-mail, fax, or other methods. 2) At the above-designated time, bids will be opened and read publicly. A representative of the vendor may be present at the bid opening, however, this is not required. No immediate decision shall be rendered concerning the proposals submitted. 3) The final decision regarding the bid award is the responsibility of the board members of Henderson County Schools. The Board shall formally consider these bids at the next regularly scheduled Board meeting after the bids are opened. The date of the Board meeting is Monday, October 23, 2023, at 6:00 p.m. Consideration of this bid by the Board at this time is contingent upon the final tabulation of the bids prior to the scheduled Board meeting. 4) Henderson County Schools has been issued a Kentucky Sales Tax Exemption Certificate # B-221. 5) No proposal may be withdrawn for a period of sixty (60) days after the official bid opening. 6) Deviations from the specifications and information requested may lead to disqualification of the proposal. 7) Henderson County Schools reserves the right to request additional information, waive defects and informalities in proposals, or reject any or all proposals in whole or in part, that do not meet all mandatory requirements, or reject all proposals received, if, in its judgment, the best interest of the school district will be served. 8) Henderson County Schools reserves the right to negotiate any or all of the terms of submitted proposals from the vendor. Henderson County Schools reserves the right to award this contract to the vendor whose overall bid serves the best interest of the Board. 9) Henderson County Schools has the right to terminate this contract at any time for cause. 10) KRS 45A.455 prohibits conflicts of interest, gratuities, or kickbacks to employees of Board in connection with contracts for supplies or services whether such gratuities or kickbacks are direct or indirect. KRS 45A.990 provides severe penalties which are designed to secure a public contract for supplies or services. The attached Conflict of Interest, Gratuities, and Kickbacks form must be completed, signed, and returned with proposal. 11) Henderson County Schools does not discriminate on the basis of race, color, national origin, age, religion, marital status, sex, sexual orientation, identity, disability, or genetic information in employment, vocational programs, or activities set forth in compliance with federal and state statutes and regulations of Title II, Title IV, Title VI, Title IX and Section 504.
