Demolition, site work and new construction of a water / sewer project in Lexington, Tennessee. Completed plans call for the demolition of a water / sewer project; for the construction of a water / sewer project; and for site work for a water / sewer project.

The envelope containing the bid shall be marked to show the bidder's Tennessee Contractor's license number, expiration date and the part of the classification applying to the bid, otherwise the bid will not be opened. The projects will include the following described construction: The furnishing, installing, and testing of a two new submersible 150-gpm duplex wastewater lift station and approximately 100 linear feet of 10-inch diameter, SDR 26 gravity sewer by open cut method, approximately 475 linear feet of 4-inch diameter, DR- 11 HDPE force main in by open cut and directional drill bore methods, 4-foot diameter manholes, drop pipe assembly, watertight frames and covers, fill and abandon existing. pump station, and appurtenances including plug valves, connections, detection tape, tracer wire, MJ fittings, backfill, tie-ins, restoration, pavement restoration, soil erosion control measures, traffic control, bypass pumping, and all other appurtenances and other work as shown on the Construction Drawings or indicated in the Contract Specifications. BID SECURITY Each Proposal shall be accompanied by a certified or cashiers check or a satisfactory bid bond payable to the City of Lexington, Tennessee in amount not less than five (5) percent of the Base Bid as a guarantee that the bidder will, within fifteen (15) days after the date of the award of the Contract, execute an Agreement and file bonds and insurance as required by the Contract Documents if his Proposal is accepted. If an intended awardee fails to execute and file an Agreement, bonds and insurance as required by the Contract Document, the entire amount of the security submitted with the Proposal shall be forfeited. LICENSE Subject to the provisions of Chapter 6 of Title 62 of the Tennessee Codes Annotated, the Contractors attention is directed to the Tennessee Codes Annotated Section 62-6-119 which states that it will be necessary for each bidder and their subcontractors to show evidence of a license before his bid will be considered and that the license number, expiration date, and that part of classification applying to the bid appear on the envelope containing the bid; otherwise the bid shall not be opened. TIME FOR COMPLETION The successful bidder shall be required to fully complete all work within 270 consecutive calendar days from and including the date to start work established in a written order from the City of Lexington, Tennessee. NOTE: The Contractor's attention is directed to the Provisions for Liquidated Damages as provided in the Supplementary Conditions and the Contract Agreement, in addition to the Excess Cost of Engineering AWARD OF CONTRACT The award of any Contract will be made by the City of Lexington, Tennessee to the lowest responsive, responsible bidder. Responsible bidder will be defined as one who fumished satisfactory evidence that the bidder has the experience and the ability and that he has sufficient capital and facilities to enable him to perform the work successfully and to complete the work within the time specified in the Contract Document. At a minimum, a responsible and responsive bidder shall be appropriately licensed by the State of Tennessee, have provided the required bid bond, have the capability of meeting the bond and insurance requirements, and be in compliance with Federal, State and local laws and regulations applicable to the project. The City of Lexington, Tennessee reserves the right to reject any Proposal for failure to comply with all requirements of the notice or of any of the Contract Documents; however, it may waive any minor defects or informalities at its discretion. The City of Lexington, Tennessee further reserves the right to reject all ADDENDA AND QUESTIONS CONCERNING BID DOCUMENTS Subject to the provisions of Chapter 4, Part 1, of Title 12 of the Tennessee Codes Annotated, The Contractor's attention is directed to the Tennessee Codes Annotated Section 12-4-126 which states the following: "(a) if a statute, ordinance, resolution, rule or regulation mandates the use of competitive bidding of any kind or nature whatsoever, by any state agency, county or municipal corporation, then, notwithstanding such law, ordinance, resolution, rule or regulation, no addenda within less than forty-eight (48) hours of the bid opening date shall be permitted. (b) Any questions concerning the bid documents must be received by the designer no less than ninety-six (96) hours before bid opening date. (c) This section shall not apply to the department of transportation contracts or any state or local agency contracts funded in whole or in part with state or federal highway funds."
