College Hill Water Treatment Plant HVAC Improvement Project. The project consists of replacing the existing 2nd floor HVAC system with a VRF (Variable Refrigerant Flow) split system heat recovery unit for heating and cooling of the 2nd floor of the College Hill Water Treatment Plant and replacement of overhead lighting fixtures along with the replacement of existing fan coil units on the 1st floor of the plant. The 2nd floor portion of this project has priority and must be completed before starting the 1st floor work. The City understands that equipment may have 4-8 weeks delivery times. The Owner is the City of Lynchburg, Virginia City. The term Owner means the Owner or its authorized representative. The Departmental Director, or his designee, is the authorized Owner's representative for this Contract. Notwithstanding the foregoing, the authority of the Owner's representative is subject to the limitations in the Lynchburg Public Procurement Code. The Departmental Director, will designate a single Owner's representative, with the title of Project Manager (PM), who will have the power to act, within the scope of his delegated authority, for and on behalf of the Owner, in accordance with the terms of the Contract Documents. Accordingly, instead of requiring any such proof, Owner and Contractor agree that as liquidated damages for certain losses Owner is expected to suffer due to delay (but not as a penalty) Contractor shall pay $50.00 for each day that expires after the time specified for completion. If the Contractor is subject to liquidated damages, the City has the right, but not the obligation, to withhold the liquidated damages from the Contractor's regular payments or retainage. Liquidated damages shall be as indicated in the Contract Documents. Bidder's Bid Bond for 5% of Base Bid Amount Issued The undersigned hereby agrees, if awarded the Construction Agreement, to execute and deliver to the City within ten (10) days after his receipt of the Notice of Award, a performance bond and a payment bond, in forms satisfactory to the City, from sureties authorized to do business in Virginia satisfactory to the City, in the amount of one hundred (100) percent of the Base Bid. The Owner reserves the right to cancel the Advertisement for Bids, reject any and all bids, waive any and all informalities, and disregard all conforming, nonconforming, conditional bids or counterproposals.
