**As of January 17, 2024, project was awarded to Western State Builders, Inc, awarded amount is $113,551.90.** The work to be performed consists of furnishing all materials, equipment, tools, labor, and incidentals as required by the plans, specifications, and contract documents. The project is an improvement to an existing park. The existing park is to remain fully operational during construction. The work includes the following: New commercial playground area. New concrete ADA sidewalk from the playground area to the southwest side of an existing sidewalk around an existing basketball court. The city reserves the right to reject all bids, waive any irregularities, or dispense with further bidding. Shall be completed in the forms provided as per Instructions to Bidders and accompanied by a Certified Check, Cashier's Check, or a Bid Bond executed in favor of the City of Brawley in an amount of ten percent of the bid, to be forfeited as fixed and liquidated damages should bidder neglect or refuse to enter into a contract. Pursuant to California Civil Code Section 9550, the successful bidder shall, before the commencement of work, furnish a payment bond to and approved by the Owner, if the public works contract exceeds twenty-five thousand dollars ($25,000) in the amount of 100% of the contract amount. The successful Bidder shall also provide a performance bond in the amount of 100% of the contract amount. The work must be completed within 60 calendar days after the commencement date stated in the Notice to Proceed. Liquidated Damages of $500.00 per calendar day are included in this project. Prospective Bidders shall be licensed Contractors in the State of California and shall be skilled and regularly engaged in the general class or type of work called for under the Contract. Each Bidder shall have a Class A or Class B California Contractor's license. A bid submitted by any contractor not properly licensed at the time of bid opening shall be considered non-responsive and will be rejected.
