T-5 Intermodal Yard Improvements. The Port reserves the right to reject any Bid if the evidence submitted by, or investigation of, such Bidder fails to satisfy the Port that such Bidder is properly qualified to carry out the obligations of the contract and to complete the Work contemplated therein. SCOPE OF PAYMENT The Contractor shall be compensated for performing the Work, including any changes made by Change Order, as provided for in this Contract. Payment of the Contract Sum shall constitute the full compensation to the Contractor for performance of the Work, including all risk, loss, damage, or expense of whatever character arising out of the nature of the Work or the prosecution thereof, and for all reasonable expenses properly incurred, including in the event of suspension or termination. *The value for this project is based on a financial range. The value is listed as the highest possible cost from the range provided by a stakeholder or official project document. The Engineer's estimate range for this project is $2.8M - $3.6M. The DBE utilization requirement is 8% for this contract. Each Bid shall be accompanied by a Bid security, cashier's check, money order, or surety bid bond, in the amount of not less than five percent (5%) of the total bid including Alternates, if any. A bid bond shall not be conditioned in any way to modify the minimum five percent (5%) required. If liquidated damages are provided in the Contract, the Contractor shall be liable for such liquidated damages until Substantial Completion of the Work, including a reasonable charge for the engineering, managerial and administrative costs incurred by the Port. After all the Work contemplated by the Contract has been completed, the Engineer will calculate the total expenses and damages for the completed Work. If the total expenses and damages are less than any unpaid balance due the Contractor, the excess will be paid by the Port to the Contractor. If the total expenses and damages exceed the unpaid balance, the Contractor and the Surety shall be jointly and severally liable to the Port and shall pay the difference to the Port.
