The Town of Windham is seeking sealed bids for the construction of a new bathroom facility concrete shallow foundation and connection to existing utilities near the Shaboo performance stage located at Jillson Square, Windham, CT. Label all sealed packages 'Shaboo bathrooms foundation and utility connections'. Bid packages shall include one hard copy and one digital copy stored on a flash drive. The proposed work consists of foundation and utility installation to existing services. Each bid must be accompanied by bid security in the form of a certified check or bid bond, in an amount equal to five percent of the amount bid. Bid security shall be made payable to the Town of Windham and shall be properly executed by the bidder. At the time of contract signage, separate 100 percent performance and 100 percent payment bonds will be provided to the Town of Windham. The Town of Windham reserves the right to waive informalities or to reject any and all of the bids and to award the project in the town's opinion its best interests will be served. Liquidated damages shall be one hundred ($100) dollars per calendar day. The Bid security of Successful Bidder will be retained until such Bidder has executed the Agreement, furnished the required contract security and met the other conditions of the Notice of Award, whereupon the Bid security will be returned. If the Successful Bidder fails to execute and deliver the Agreement and furnish the required contract security within fifteen days after the Notice of Award, OWNER may annul the Notice of Award and the Bid security of the Bidder will be forfeited. The Bid security of other Bidders whom OWNER believes to have a reasonable chance of receiving the award may be retained by OWNER until the earlier of the seventh day after the Effective Date of the Agreement or the thirty-sixth day after the Bid opening, whereupon Bid security furnished by such Bidders will be returned. Bid security with Bids which are not competitive will be returned within seven days after the Bid opening. The time of completion shall be one hundred eighty (180) days from the issuance of a Notice to Proceed unless lead times on certain items are shown and written notice by the Engineer provided. When OWNER gives a Notice of Award to the Successful Bidder, it will be accompanied by the required number of unsigned counterparts of the Agreement with all other written Contract Documents attached. Within ten (10) days thereafter, CONTRACTOR shall sign and deliver the required number of counterparts of the Agreement and attached documents to OWNER with the required Bonds. Within ten (10) days thereafter, OWNER shall deliver one fully signed counterpart to CONTRACTOR.
