In its sole discretion, the Barry County Road Commission reserves the right to waive any irregularities in any bids, to reject any or all bids, and to accept bids other than the lowest responsible bid. No bid may be withdrawn after the schedule closing time for receiving bids and for a period of 90 days thereafter. The Barry County Road Commission reserves the right to (a) reject any or all Bids, including nonconforming, nonresponsive, unbalanced, or conditional bids; (b) reject the bid of any Bidder whom it deems to be nonresponsible; (c) reject the bid of any Bidder that it believes would not be in the best interest of the Barry County Road Commission; (d) waive all informalities not involving price or time; and (e) negotiate contract terms with the successful Bidder. If the contract is to be awarded, the Barry County Road Commission will award the contract to the Bidder whose bid is in the best interest of the Barry County Road Commission, as determined in its sole discretion. Culverts CMP Smooth lined corrugated polyethylene Concrete Class III Questions received less than seven (7) days before the bid opening may not be answered.
