Any alteration, insertion, or erasure by the proposer in the form of the RFP documents as originally prepared by RTD shall render the accompanying proposal non-responsive and may constitute cause for rejection. Conditional proposals or those that take exception to the RFP documents or Scope of Work may be treated as non-responsive. Upon request, the Contractor shall provide a description of each primary manager/supervisor's job duties, how much control they will have over the operation at the local level, when they will be available, and how much of their time will be dedicated to the Contract during the start-up and on-going operations. The Contractor must provide a description of all Key Personnel job duties, how much control they will have over the operation at the local level, when they will be available, and how much of their time will be dedicated to the contract during the start-up and on-going operations. A description of the nature of the Work rendered by or to be rendered on the Contract or related to the Contract. Previous experience of the proposed team (including subcontractors) and key personnel in performing on projects of a similar nature and scope. RTD shall not pay the Contractor for any Work performed or for any cost incurred by the Contractor or subcontractors prior to the Period of Performance, unless those costs are incurred pursuant to RTD written notice to proceed and the costs are directly related to deliverable items set forth in the Scope of Work. Liquidated Damages means a fixed dollar amount that may be assessed to the Contractor due to Contractor's failure to fulfill a Contract requirement as set forth in Attachment A. Due to the nature and significance of the Work, the Contractor and RTD agree that a failure to perform the Work will likely result in severe economic loss to RTD. In addition, the Contractor and RTD also agree that it is extremely difficult to determine actual damages that may result from the Contractor's failure to perform the Work. Consequently, this Contract may allow RTD to assess certain Liquidated Damages for certain failures by the Contractor to perform the Work, as set forth in Attachment A. Liquidated Damages provisions as defined in the Contract are assessed by RTD as such damages identified. The Contractor's liability for any single failure to perform that portion of the Work identified in this Section for which a Liquidated Damage is affixed is limited to and fixed at the sum of Liquidated Damages provided herein. Assessment of Liquidated Damages shall not constitute a waiver of RTD's right to terminate the Contract for the Contractor's default for ongoing failures to perform the Work or any other failure by the Contractor to perform the Work for which RTD has not assessed Liquidated Damages or not specifically identified herein. Five Thousand and no/100 Dollars ($5,000.00) per month for the Contractor not being in compliance with the originally proposed/approved staffing levels (or subsequently revised/approved staffing levels) for managerial, supervisory, and administrative staff assigned to the Contract. Contractor shall have 90 days to fill vacant positions before Liquidated Damages are assessed. Question Response Deadline:March 7, 2024, 4:00pm Wage Information. There are no minimum wages stated for contracted fixedroute service. The following information is provided for reference. RTD represented employees and the bus operators of the current private contractors (First Transit and Transdev) are represented by the Amalgamated Transit Union (ATU) Local 1001 (RTD and First Transit) and Local 1772 (Transdev). The following is a summary of wages for RTD and the current private contractors. Bond Notes: A Performance Guarantee in the amount of 100 percent of the Contract value is required by RTD to ensure faithful performance of the Contract. Either a Performance Bond or an Irrevocable Stand-By Letter of Credit shall be provided by Contractor and shall remain in full force for the term of the Contract. RTD requires all Performance Bonds to be provided by a fully qualified surety company acceptable to RTD and listed as a company currently authorized under 31 C.F.R. Part 22 as possessing a Certificate of Authority as described hereunder. RTD may require additional performance bond protection when the Contract price is increased. The increase in protection shall generally equal 100 percent of the increase in Contract price. RTD may secure additional protection by directing Contractor to increase the amount of the existing bond or to obtain an additional bond. The issuing bank's obligation to pay will arise upon the presentation of the original Letter of Credit and a certificate and draft to the issuing bank's representative at a location and time to be determined by the parties. This documentation will indicate that Contractor is in default under the Contract. Set Aside: f the contractor does not make payments to a trustee or other third person, the contractor may consider as part of the wages of any laborer or mechanic the amount of any costs reasonably anticipated in providing bona fide fringe benefits under a plan or program, Provided, That the Secretary of Labor has found, upon the written request of the contractor, that the applicable standards of the Davis-Bacon Act have been met. The Secretary of Labor may require the contractor to set aside in a separate account assets for the meeting of obligations under the plan or program.
