All bids shall be accompanied by a certified check, or a Bid Bond made payable to the Wilkes-Barre Housing Authority with corporate surety in an amount of not less than ten (10%) percent of the Bid as a guarantee that the bidder will execute the Contract if awarded the same. The surety Bond, Bid Bond, and the attorney-infact that executes the Bond on behalf of the surety shall affix to the Bond a certified and current copy of the Power-of-Attorney. If the bid is not accepted, the Bid will be returned to the Bidder. In the event the Bidder fails, within ten (10) days fail Notice of Award, to sign the contract or fails to comply with the bonding or insurance requirements hereinafter stated, the good faith deposit (BID BOND) shall be forfeited to the Housing Authority as Liquidated Damages. Within ten (10) days after the Notice of Award, the successful bidder shall execute the agreement between the owner and the Contractor. Within three (3) days following the date of execution of the Contract, the successful bidder shall deliver the Performance Bond and Payment Bond, each in the amount of 100% of the Contract Sum, and a Certificate of Insurance in the amounts specified. The Bonds shall be included in the Bid. The Bidder shall require the Attorney-In-Fact that executes the required Bonds on behalf of the surety to affix thereto a certified and current copy of the power of Attorney. All contractors and subcontractors will be required to adhere to Section 3 of the Housing and Urban Development Act of 1968 as amended. The successful bidder shall pay all required taxes. The agreement shall include a stipulation that Liquidated Damages will be paid in the amount of$200.00 / consecutive calendar day following the deadline date as set forth in the Owner / Contractor Agreement will be paid to the Owner. The Contract Time shall be 90 consecutive calendar days from the "Contract Signing". Wilkes-Barre Housing Authority reserves the right to accept or reject any or all bids and to waive any informality in the bidding
