Furnishing of all labor and materials and equipment for the WALNUT RANCH PARK STORM DRAIN IMPROVEMENTS. The CONTRACTOR, hereinafter "the CONTRACTOR" to whom this contract is awarded will be required, before execution of the contract by the City of Walnut, hereinafter "the AGENCY," to file with said AGENCY surety bonds as follows: A "Faithful Performance Bond" amounting to 100% of the total contract price is required for all contracts. A "Payment Bond" (labor and material) amounting to 100% of the total contract price is required for all contracts. A "Certificate of Public Liability and Property Damage Insurance," naming the City of Walnut, including its elected or appointed officials, directors, officers, agents, employees, volunteers, or contractors, named and endorsed as additionally insured. See "Insurance and Bonds" paragraphs within the Special Instructions to Bidders Section. And a certificate relative to Worker's Compensation/Employer's Liability Insurance. Surety bonds shall be subject to the condition that the surety thereon be approved by the AGENCY Attorney and AGENCY Council. Standard Surety Company bonding forms are accepted. Each submitted bid proposal must be accompanied by a certified or cashier's check, or a surety bond, payable to the City of Walnut in the amount equivalent to at least 10% of the total aggregate bid price of such bid proposal, as a guaranty that the bidder, if its bid proposal be accepted, will enter into and execute the awarded contract, and furnish the required bonds in connection therewith, in accordance with the terms of the aforementioned Specifications. Pursuant to the provisions of Sections 1770 to 1777, inclusive, of the California Labor Code, the State has ascertained the general prevailing rate of per diem wages for each craft or type of worker needed to execute the proposed contract, and it will be required that not less than said rates be paid to all such workers employed or engaged in the work. Complete wage rate schedules are on file at the Office of the City Clerk of the City of Walnut. The rate of compensation for any classification not listed in the schedule, but which may be required to execute the proposed contract, shall be commensurate and in accordance with the rates specified for similar or comparable classifications or for those performing similar or comparable duties. No Contractor or Sub-Contractor may be listed on the proposal unless they are registered with the Department of Industrial Relations (DIR) pursuant to Labor Code Section 1725.5. No bid proposal will be accepted from a CONTRACTOR who has not been licensed in accordance with the provisions of the Business and Professions Code. The successful CONTRACTOR and his Subcontractors will be required to possess business licenses from the City of Walnut. As provided for in Section 4590 of the California Government Code, the CONTRACTOR may substitute securities for any monies withheld by the AGENCY to ensure performance under the contract. The AGENCY reserves the right to reject any and all bid proposals, to waive any irregularity, and to take all Bid Proposals under advisement for a period of sixty days. TIME OF COMPLETION AND LIQUIDATED DAMAGES: BIDDER must agree to commence work on or before the date of the written "Notice to Proceed" of the AGENCY and to fully complete all work to the satisfaction of the Engineer within thirty (30) working days. BIDDER must agree also to pay as liquidated damages, the sum of five hundred dollars ($500.00) for each working day thereafter as provided in these Specifications. The Notice to Proceed is anticipated to be issued for work to commence on June 17, 2024. The contractor shall complete all portions of work within the playing field (grass area) with the playing fields completely restored by July 19, 2024. At the time of request for contract documents, the requestor must furnish a mailing address, e-mail address and telephone number which the requestor agrees is sufficient to reach him. If the mailing address involves a P.O. Box number, the requestor must also furnish an actual office (street) address which he also agrees is sufficient to reach him. The contract Specifications include by reference the "Standard Specifications for Public Works Construction," Latest Edition, as published by Building News, Inc., which is not included in the price quoted above. The "Standard Specifications for Public Works Construction," Latest Edition, is available at Building News, Inc., 1612 South Clementine Street, Anaheim, CA 92802 (714) 517- 0970. Price varies with quantity ordered. BID PROPOSAL GUARANTY: Each Bid Proposal must be accompanied by cash, cashier's check, certified check or by a bid bond in the amount of ten percent of the bid price payable to the City of Walnut as a guarantee that the bidder, if his bid proposal is accepted, will promptly execute the contract, secure payment of Worker's Compensation Insurance, furnish a satisfactory Faithful Performance Bond in the amount of 100 percent of the total base bid price, and a Labor and Material Bond in the amount of 100 percent of the total base bid price. The Bid Proposal bond must be duly executed by the bidder and a financially sound surety company authorized to transact business in this state and whose name is on file with the County Clerk of the County of Los Angeles as an approved and financially sound surety company. The CONTRACTOR is required to pay the prevailing wage rates referred to above and pursuant to Section 1775, Labor Code (State of California), he shall forfeit not more than fifty ($50.00) dollars for each calendar day, or portion thereof, for each workman paid less than the stipulated prevailing rates for any public work done under the contract by him or by any Subcontractor under him. CITY'S RIGHTS RESERVED: The City of Walnut reserves the right to reject any and all bid proposals, should it deem this necessary for the public good, and also the Bid Proposal of the bidder who has been delinquent or unfaithful in any former contract with the City of Walnut. No BIDDER may withdraw his Bid Proposal for a period of sixty (60) days after the date of the bid proposal opening. PREPARATION OF BID PROPOSAL FORM: The AGENCY invites Bid Proposals on the form attached to be submitted at such time and place as is stated in the Notice Inviting Sealed Bid Proposals. All Bid Proposals should be made in accordance with the provisions of the Standard Specifications for Public Works Construction, Latest Edition. All blanks on the Bid Proposal form must be appropriately filled in. All Bid Proposals shall be submitted in sealed envelopes bearing on the outside the name of the BIDDER, his address, and the name of the project for which the Bid Proposal is submitted. It is the sole responsibility of the BIDDER to see that the bid proposal is received in proper time. Any Bid Proposal received after the scheduled closing date and time for receipt of bid proposals will be returned to the BIDDER unopened. STATE DIRECTOR OF INDUSTRIAL RELATIONS (DIR): Any Contract entered into pursuant to this notice will incorporate the provisions of the State Labor Code. Compliance with the prevailing rates of wages, apprenticeship employment standards, and Contractor registration program and the electronic submission of certified payroll reports established by the State Director of Industrial Relations will be required. Affirmative action to ensure against discrimination in employment practices on the basis of race, color, national origin, ancestry, sex, or religion will be also required. The Engineer's Estimate for this project is -200,000.00 SCOPE OF WORK: Scope of work shall consists of furnishing all labor, materials, equipment, and services in performing all work necessary for and related to the construction of improvements included in the Contract Documents and Specifications, Project Plans, and Bid Item Descriptions that follow. These improvements for Walnut Ranch Storm Drain Improvements shall consist of concrete sidewalk, curb, V-ditch, constructing 18” RCP and 8” SDR 35 storm drain pipe and fittings, concrete collars, and various inlet types in accordance with contract documents and specifications, project plans and these Special Provisions.
