The City of Pittsburgh, Office of Management and Budget is soliciting bids for Pre-Mixed Bituminous Cold Patching Materials for the City of Pittsburgh. Question Submission Deadline:May 3, 2024, 3:00pm All questions shall be submitted via "Q&A" feature on OpenGo Contractor will furnish material, equipment, tools, labor, and incidental work complete and in place, unless otherwise provided, and be responsible for the complete supervision, performance, and completion of the Work. Contractor must perform the Work strictly in accordance with the Contract and the Director's orders and instructions. Contractor must strictly comply with all dates, deadlines, and milestones under the Contract as time is of the essence for each. Contractor must maintain, update, and make available upon request a copy of all documents arising under the Contract. Contractor affirms that Contractor has thoroughly examined the Advertisement, Specifications, and Site. Contractor fully understands the conditions to be encountered; the character, quality, and quantities of Work to be performed; the material to be furnished; and the requirements of the Site, Specifications, and Advertisement. Contractor assumes all risks and costs arising from a failure to comply with this provision, and the City will make no allowance or concession for such failure. All material shall be delivered within twenty-four (24) hours of verbal notification. Prior to preparing bids for the items to be delivered to specific sites within a region, suppliers are aware of and agree to the following conditions: Suppliers, once awarded a contract, are responsible for supplying materials as required, and if unable to supply, are responsible for arranging for an alternate source of supply, all at no additional cost to the City
In the event a contracted supplier is unable to both supply material as ordered and fails to supply material through an alternate source of supply; or should the material fail to perform in accordance with performance characteristics stated under the Performance Guarantee, the City reserves the right to:
Contract with another supplier of these materials and to pass any additional cost for doing so onto the contractor.
Cancel the supplier's contract with immediate effect.
Prices are requested with the understanding that any quantity may be used. The bidder shall provide a statement that the product purchased pursuant to this agreement is not manufactured or processed at a facility that burns hazardous waste as a fuel. WHEREAS sufficient data and evidence as to the safety of cement products made from the burning of hazardous waste has not been proven, it is in the best interest and health to the citizens of the City of Pittsburgh that the City will not purchase products from any facility that burns hazardous waste as a fuel in its manufacturing process, nor allow the use of products made from this type of hazardous waste.
