It is the intent to purchase Wood Traffic Safety Barriers on an as needed basis. Price: Price Shall Be Net F.o.b. Department of Public Works, Highway Maintenance Yard, Carleton Ave., Central Islip, NY 11722 or Any Point in the Town of Islip and Shall Remain in Effect for Three (3) Years From Date of Award With the Town's Option to Renew for One (1) Additional Year Under the Same Terms and Conditions. Quantity: Estimated Yearly Requirement is Approximately 300 Units, (Two (2) Stanchions and One (1) Rail); However, the Contract Shall Be for the Amount Actually Ordered and Delivered During the Contract Period. Delivery: Shall Be Made in Lots of Fifty (50) Units (Two (2) Stanchions and One (1) Rail) With the First Delivery to Be Made Within Five (5) Weeks After Receipt of Order in Quantities as Directed. Deviations: Any Deviations From the Specifications Must Be Covered by a Letter Submitted With the Bid Plainly Addressing the Change. Otherwise the Purchasing Authority Will Deem the Traffic Barrier to Be as Specified and Upon Receipt and Inspection, Have the Authority to Return the Unit(S) for Non-compliance With the Specifications. Contract Period 3 Yrs From Date of Award W/ 1 Yr Option The Failure of Any Bidder to Receive Such Addenda Will Not Relieve the Bidder of Any Obligation Under His Bid as Submitted. Any Addenda So Issued Shall Become Part of the Contract Documents. Governing Law and Forum Selection: Any Dispute Arising Under or in Connection With This Contract Shall Be Brought Only in the State Courts Located in Suffolk County, New York. The Contractor Consents to the Exercise of Jurisdiction by the Courts of the State of New York. Any Changes Made to the Town's Terms and Conditions May Cause the Vendor's Bid to Be Disqualified. Quantity Reports: It Will Be the Responsibility of the Successful Vendor to Supply the Town With Year-to-date Reports Indicating Quantities Purchased and/or Man-hours Provided. This Report Shall Be Submitted to the Town Within Two (2) Weeks of Request. The Islip Town Board Reserves the Right to Waive Any Formality and/or Informality or to Reject Any or All Bids Received or to Award a Contract to One or More Bidders for an Item, Group(S) of Items or All Items of the Bid, When in the Opinion of the Town Board, Such an Action Will Be in the Best Interest of the Town. In the Event Bids Are Rejected or No Bids Are Received, the Purchasing Department is Authorized to Re-advertise for Bids.
