Mill Woods Park Pond and Swimming Pond Dam Improvements. Liquidated Damages For this project, a sum of EIGHT HUNDRED DOLLARS ($800.00) is agreed to by all Bidders as liquidated damages, and shall be paid by the Contractor to the Town for each and every calendar day in which this Contract is not completed after the period of time stipulated herein for such completion, and such costs shall be fixed with regard to this provision. The length of time to complete work associated with this project will be NINETY (90) CALENDAR DAYS after receiving a written notice to proceed from the Town, which at this time, is expected to be issued by sometime in JULY. A bid bond or certified check in the amount of 5% of bid is required to be submitted with the Bid. Bid Security will be returned to all except the successful bidder upon award. Basis of Award This contract shall be awarded to the lowest responsible and qualified Bidder. Qualifications shall include the ability of the Contractor to complete all work within the stated time frame and history of performance on previous projects. The Town of Wethersfield, after review of all factors, including the terms and conditions, qualifications and price, reserves the right to accept or reject any and all bids, or any part thereof, or waive defects in the same, or accept any proposal or combination of proposals deemed to be in the best interest of the Owner. All bid documents must be completely filled out when submitted. Bids must be firm for a period of 90 days following the bid opening date. Bid withdrawal may be made only with the consent of the Town of Wethersfield. Complete dam embankment improvements at the Pond Park Dam and Swimming Pond Dam located in Mill Woods Park at 154 Prospect Street, which include removing trees greater than 3" in diameter and root balls on or in close proximity to the dam embankments, backfill, compaction, installation of slope stabilization and erosion control measures, and concrete and pipe joint repairs. Owner reserves the right to change the scope of the project for any reason before or after the bid is awarded without penalty to the Owner. The Owner reserves the right to reduce or increase any or all quantities shown on the Bid Form or eliminate items of work entirely as may be in the best interest of the Town without penalty.
