Separate sealed Bids will be received for the Rockingham County Landfill 5B Expansion project, located along Greendale Road, Harrisonburg, VA. Work includes the construction of a new cell Additionally, A removable media storage device containing two (2) digital copies of the proposal, one as submitted, and one as redacted to remove all confidential and proprietary material, must be included in the proposal packet. A Bid must be accompanied by Bid security made payable to Owner in an amount of 5% percent of Bidder's maximum Bid price and in the form of a certified check or bank money order or a Bid bond (EJCDC No. C-430, 2002 Edition) issued by a surety meeting the requirements of Paragraphs 5.01 and 5.02 of the General Conditions A Pre-Bid conference will be not be held. All questions shall be submitted to the ENGINEER in writing. Questions will be submitted no later than 4:00 pm on June 15th, 2024 The date of Substantial Completion is November 30th, 2024 and the date for readiness for final payment is December 31st, 2024. Withdrawal of bids due to error shall be in accordance with Virginia Code Section 2.2-4330.B.2. Should the apparent low bid exceed available funds, the Owner reserves the right to negotiate with the apparent low bidder to obtain a contract price within available funds. Bidders shall comply with Virginia Code regarding information required with bid. Envelopes containing bids shall be clearly marked with the Bidder's contractor license number. Contractor and Owner recognize that time is of the essence of this Agreement and that Owner will suffer financial loss if the Work is not completed within the times specified in Paragraph 4.02 above, plus any extensions thereof allowed in accordance with Article 12 of the General Conditions. The parties also recognize the delays, expense, and difficulties involved in proving in a legal or arbitration proceeding the actual loss suffered by Owner if the Work is not completed on time. Accordingly, instead of requiring any such proof, Owner and Contractor agree that as liquidated damages for delay (but not as a penalty), Contractor shall pay Owner $600 for each day that expires after the time specified in Paragraph 4.02 for Substantial Completion until the Work is substantially complete. After Substantial Completion, if Contractor shall neglect, refuse, or fail to complete the remaining Work within the Contract Time or any proper extension thereof granted by Owner, Contractor shall pay Owner $400 for each day that expires after the time specified in Paragraph 4.02 for completion and readiness for final payment until the Work is completed and ready for final payment. Owner reserves the right to reject any or all Bids, including without limitation, nonconforming, nonresponsive, unbalanced, or conditional Bids. Owner further reserves the right to reject the Bid of any Bidder whom it finds, after reasonable inquiry and evaluation, to be non-responsible. Owner also reserves the right to waive all informalities not involving price, time, or changes in the Work and to negotiate contract terms with the Successful Bidder. *The bid list for this project may be incomplete.
