Three-year contracts for the grounds maintenance work at the Silverbrook Cemetery. All bidders are required to sign a certification that they will comply with all Federal and State nondiscrimination laws and regulations. A certified check or bidder's bond in an amount of not less than five percent (5%) of the amount equal to the value of the first year of the contract will be required with each proposal. The City reserves the right to reject any or all proposals, to waive irregularities in proposals and to accept the proposal which in the opinion of the City Council is most advantageous to the City. No bid shall be withdrawn after the opening of bids for a period of thirty (30) days after the scheduled time of receiving bids. The City reserves the right to accept any proposal, or reject any or all proposals, and to waive defects or irregularities in any proposal. In particular, any alteration or erasure in the contract documents which are attached hereto and specifically made a part of these instructions and of the form of proposal, shall render the accompanying proposal irregular and subject to rejection by the City. Award of Contract The contract shall be deemed as having been awarded when formal notice of award shall have been duly served upon the bidder to whom the City contemplates awarding the contract by the City Administrator or Public Works Director. In lieu of the 10% retainage withheld from each monthly payment, the Contractor may instead choose to furnish the City with performance and labor and material bonds with surety acceptable to the City; one bond to be executed to the City of Niles to be in the amount of one hundred percent (100%) of the full contract price and to be conditioned for the faithful fulfillment of the contract and to include the protection of the City from all liens and damage arising out of the work; and the other bond to be executed to the people of the State of Michigan; to be in the amount of one hundred percent (100%) of the full contract price to be conditioned for the payment of all labor and materials used in the work and for the protection of the City from all liens and damages arising there from. The contract period shall commence April 1, 2025 and terminate on December 1, 2027 (three working seasons).
