The Bidder further declares that he has carefully examined the Contract Documents; that he has personally inspected the site; that he has satisfied himself as to the quantities involved, including materials and equipment, and conditions of work involved, including the fact that the description of the quantities of work and materials, as included herein, is brief and is intended only to indicate the general nature of the work and to identify the same quantities with the detailed requirements of the Contract Documents; and that this Proposal is made according to the provisions and under the terms of the Contract Documents, which Documents are hereby made a part of this Proposal. The Bidder further agrees that he has exercised his own judgement regarding the interpretation of surface and subsurface information and has utilized all data which he believes pertinent from the Engineer, Owner, and other sources in arriving at his conclusions. The Bidder further agrees that all of the applicable provisions of Oregon Law relating to public contracts (ORS Chapter 279) are, by this reference, incorporated in and made a part of this proposal. The Bidder further agrees that if this Proposal is accepted, he shall, if requested by the Engineer, submit a statement of qualifications in a form adopted by the State of Oregon Public Contract Review Board and/or a list of names of subcontractors he intends to utilize in the execution of the contract, within twenty-four (24) hours of the request. The Bidder further agrees that if this Proposal is accepted, he will, within ten (10) calendar days after notification of acceptance, execute the Contract with the Owner on the form of Contract annexed hereto; and will, at the time of execution of the Contract, deliver to the Owner the Performance Bond and the Labor and Material Payment Bond both required herein; and will, to the extent of his Proposal, furnish all machinery, tools, apparatus, and other means of construction and do the work and furnish all materials necessary to complete the work in the manner, in the time, and according to the methods as specified in the Contract Documents and required by the Engineer thereunder. The Bidder further agrees to furnish the Owner, before commencing the work under this contract, the certificate of insurance as specified in these documents. The Bidder further agrees to commence work following the issuance of a "Notice to Proceed" by the Owner and fully complete the project by June 30, 2025. Once the Contractor has moved onto the project site, work shall commence and continue, uninterrupted, until fully complete and accepted by the City. In the event the Bidder is awarded the contract and shall fail to complete the work within the time limit or extended time limit agreed upon, as more particularly set forth in the Contract Documents, the Bidder further agrees to pay liquidated damages, until the work is finished, as specified in these Documents. The Bidder further proposes to accept as full payment for the work proposed herein the amount computed under the provisions of the Contract Documents and based on the following unit price amounts, it being expressly understood that the unit prices are independent of the quantities involved, that said unit prices represent a true measure of the labor and material required to perform the specified unit of work, including all allowance for overhead and profit for each type and unit of work called for in these Contract Documents. The amounts shown shall be shown in both words and figures. In case of a discrepancy, the amount shown in words shall govern. It is agreed that if the Bidder is awarded the Contract for the work herein proposed and shall fail or refuse to execute the Contract and furnish the specified Performance Bond and the Labor and Material Payment Bond within ten (10) calendar days after receipt of notification of acceptance of his Proposal, then, in that event, the Proposal Guaranty deposited herewith according to the conditions of the Invitation for bids and General Conditions shall be retained by the Owner as liquidated damages; and it is agreed that the said sum is a fair measure of the amount of damage the Owner will sustain in case the Bidder shall fail or refuse to enter into the Contract for the said work and to furnish the Performance Bond and the Labor and Material Payment Bond as specified in the Contract Documents. Proposal Guaranty in the form of a certified check shall be subject to the same requirements as a bid bond. Scope of Services The selected Contractor will provide the City with professional services to realize the successful completion of the scope of work. The Contractor will be responsible for coordinating work with all sub-contractors. The list and order of activities outlined below may be amended and finalized with the Contractor. The scope of work includes, but is not limited to, the following elements: Activity 1. Design Design of UA playground and access to expand recreational opportunities Full design for the proposed UA playground from concept sketches through construction documents including specifications Activity 2. Demolition Demolition and removal of existing play structures Activity 3. Construction Installation of all components Obtain all applicable permits Components must be properly cared for during transport, staging and installation to prevent excessive stress and abrasions Contractor shall be responsible for all costs associated with repair of damaged components or costs associated with the replacement Question Submission Deadline October 2, 2024, 4:00pm Paul Downey, the Assistant City Manager/ Finance Director, will issue the RFP document and will be the point of contact for the City for questions and protests concerning the RFP.
