One (1 ) Digital Link for the Contract Documents (Drawings and Specifications) will be emailed to qualified General Contractor Bidders. Subcontractors and Material Suppliers will need to receive digital documents through a General Contractor Bidder. The attention of the Bidders is directed to Title 54, Chapter 11, Code of Virginia, 1950, as currently amended, which requires evidence of Certificate of Registration before Bid may be received and considered (i) on a general or subcontract of $120,000 or more, or (ii) if the total value of all Contracts undertaken by the Bidder during a twelve-month period is $750,000 or more. The Bidder acknowledges the right of the Owner to accept any Bid, reject any or all Bids and to waive any informality or irregularity in any Bid received. In addition, the Bidder recognizes the right of the Owner to reject a Bid if the Bidder failed to furnish any required documents, or to submit the data required by the Bidding Documents, or if the Bid is in any way incomplete or irregular or to accept a Bid which is deemed to be in the best interest of the Smyth County, VA. If the Bid from the lowest responsible Bidder exceeds available funds, the Owner reserves the right to negotiate with the apparent low Bidder to obtain a Contract Price within available funds No Bid may be withdrawn for a period of forty-five (45) days after the opening of Bids, unless the Bid is substantially lower than the other Bids because of a clerical error as defined in Section 2.2-4330 (A) of the Code of Virginia, 1950, as amended. The Bidder must give to the Smyth County, VA a notice in writing of the request to withdraw a Bid within two (2) business days after the conclusion of the opening of Bids.
