Closing Time: 3:00 PM (NT) ** Please note that there has been 1 addendum issued for this RFQ. ** Question Acceptance Deadline 2025/01/16 03:00:00 PM NST The Authority anticipates that the general scope of the Private Partner's responsibility under the Project Agreement will be as follows: (a) Design The Private Partner will be responsible for all aspects of the design for the Project and integration of the new Highway with existing infrastructure. The final design must conform to the performance specifications that will be included in the Project Agreement, and all applicable laws, codes and standards. (b) Construction The Private Partner's construction responsibilities will include, but are not limited to: (1) Earthworks, excavation and grading; (2) Excavation support and ground stabilization; (3) Concrete and/or asphalt pavement; (4) Landscaping; (5) Environmental mitigation erosion and sediment control, environmental protection (wildlife, vegetation and fish); (6) Drainage and stormwater management and watercourse realignments; (7) Retaining walls; (9) Auxiliary structures (such as culverts, underpasses, river spans and overpasses); (10) Signage and pavement markings; (11) Lighting and signals (including sourcing power); (12) Maintenance facilities along with associated municipal approvals where applicable; (13) Archaeological investigations; (14) Animal control fencing, gates and crossings; (15) Regulatory applications and approvals; (16) Quality Control and Quality Assurance management, testing, inspection and reporting; (17) Traffic management, including public notifications, during construction including diversions, closures and detours; (18) Temporary works and construction staging (including roads, bridges and structures); (19) Protection of endangered species; (20) Preserving water quality; and (21) Environmental Assessment commitments and Environmental Assessment conditions of approval. The following are some of the key commercial terms that the Authority anticipates will be included in the Project Agreement: (a) Term: The term of the Project Agreement is anticipated to continue for 30 years following the anticipated Service Commencement of the Project. It is anticipated that construction will commence in 2026 and the Highway will be substantially complete and available for use in 2030. (b) Payment: In addition to the milestone payment referenced in Section 2.3.2 (c), the Authority will make monthly service payments to the Private Partner following Service Commencement; (c) Payment Deductions: The Project Agreement will permit the Authority to make deductions from the service payments if the Private Partner fails to keep lanes available for use as required by the Project Agreement or fails to meet the defined performance standards; and (d) End of Term: The Project Agreement will describe the hand-back requirements for the Highway assets at the end of the term.
