Furnish and Deliver On-Site Sodium Hypochlorite Generation System Master Parts List. Price list, furnish and deliver on-site sodium hypochlorite generation system (OSG) master parts list in accordance with of the Provisions, Master Price List Parts and General Conditions (bid documents) in this order of priority. All products purchased under this price list shall be for the exclusive use of the Department of Water Supply (Department) on an as-needed basis. This price list agreement shall be for a period of one year after the notice to proceed, and may be extended, in all or part, by mutual agreement for one additional year. At the time of price list extension, by mutual agreement, a price increase of up to four percent may be considered. In order for a requested price increase to be considered, the awarded vendor must provide the necessary documents justifying the requested change in price and must be approved by the Department of Water Supply. The Department reserves the right to delete, decrease, or increase any individual item or items if required to do so in relation to funds available or for any other reason. All Bidders are cautioned that this a price term agreement without any estimated quantity, and, in fact, as few as none of any item may be purchased. The Director reserves the right - a. to accept or reject any or all bids and to waive any minor or inadvertent discrepancy in the bid documents; and, b. to withhold award of contract for a period of thirty (30) calendar days from the date of bid opening. The Liquidated Damages. The seller recognizes and agrees that time is of the essence under this agreement and, due to the speculative character and difficulty of ascertaining damages to the Department of Water resulting from any delay beyond controversy and dispute, will agree that the seller shall pay to the Department of Water the sum of ONE HUNDRED AND NO/100 DOLLARS ($100.00) as liquidated damages and not as a penalty for each day that furnishing and delivery of the material contemplated in this agreement remains uncompleted beyond the time set herein for completion; provided, however, that the remedy of liquidated damages shall be in addition to any other rights and remedies otherwise available to the Department of Water Supply and not expressly waived herein.
