Contract 1 - $4,600,000 Contract 2 - $2,000,000 Contract 3 - $175,000 Contract 4 - $30,000 Each Proposal shall be accompanied by cash or by certified check or Bidder's Bond in favor of Lower Burrell Municipal Authority in an amount not less than ten percent (10%) of the amount of the Proposal, as evidence the Bidder will accept and carry out the conditions of the Contract in case of award. The Lower Burrell Municipal Authority reserves the right to waive any informalities, or to reject any or all Bids. The Successful Bidder will be required to enter into a Contract with the Lower Burrell Municipal Authority and to furnish a Performance Bond and Labor and Material Bond in the full amount of their Bid. No Bidder may withdraw their Bid within 90 days after the actual date of opening thereof. All applicable laws, ordinances and the rules and regulations of the authorities having jurisdiction over the work shall apply to the Contract throughout. Bidders will be required to execute a Non-Collusion Affidavit and submit it with their Bids. The Successful Bidders will be required to comply with all Federal, State, and local Laws and Regulations governing prevailing wage determination and fair employment practices which may be applicable to this Contract. The Build America, Buy America Act (BABAA), also known as the Infrastructure Investment and Jobs Act (P.L. 117-58) requirements applies to this project. This Act requires that all iron and steel products, all manufactured products, and all construction materials used in the project are produced and manufactured in the United States. Refer to the Memorandum and Guidance titled "Initial Implementation Guidance on Application of Buy America Preference in Federal Financial Assistance Programs for Infrastructure". Gu The Consolidated Appropriations Act of 2014 (P.L. 113-76) includes an "American Iron and Steel (AIS)" requirement also applies to this project. All iron and steel products used in this project must be produced in the United States. Refer to the Memorandum and Guidance titled "Implementation of American Iron and Steel provisions of P.L. 113-76, Consolidated Appropriations Act, 2014". The Contractor shall also comply with the provisions of the Act of March 3, 1978 (P.L. 6, No. 3 known as the "Steel Procurement Act"). The obligations imposed on the Owner by the financing agency shall apply to and be acceptable to the successful bidder. Funding for this project is being provided by the Pennsylvania Infrastructure Investment Authority (online), consisting of federally funded EPA financial assistance dollars and therefore requires all contractors to demonstrate compliance with federal Executive Orders 11625, 12138, and 12432 and EPA Regulations at 40 CFR Part 33, through the detailed documentation of solicitation of Disadvantaged Business Enterprises (DBEs). Contractors must demonstrate the Six Good Faith Efforts to identify and solicit DBE firms that are potential sources for any procurement action in the areas of project construction, equipment, services, and supplies by including state qualified small businesses, and minority and women owned business enterprises in the bidding process. Bidders are advised that this project is being financed by the Pennsylvania Infrastructure Investment Authority (online). The attention of the Bidders is also directed to the Disadvantaged Business Enterprise (DBE) and the Super Cross Cutter Requirements for Construction Projects funded under the PennVEST Clean Water and Drinking Water State Revolving Fund loan programs. Bidders must submit DBE contact and commitment documentation with the Bid. Question Deadline 02/03/2025 All questions about the meaning or intent of the Contract Documents, Specifications or Drawings are to be directed to the Engineer. Interpretations or clarifications considered necessary by the Engineer in response to such questions will be issued by Addenda mailed or delivered to all parties recorded by Engineer as having received the Bidding Documents. Questions received less than seven days prior to the date for opening of bids may not be answered.
