Andrew Jackson Elementary School - UPK Modular Building The Owner reserves the right to add or deduct any of the additive or deductive items after the lowest responsible and responsive bidder is determined. The lowest bid shall be determined on the amount of the base bid. The intent is to have the Modular building onsite within 5 months after DSA Approval, Liquidated damages for delay shall accrue. See Article III of the Agreement for details. In accordance with Section 3300 of said Code, the bidder shall have a Class "B" license at the time of award and shall maintain that license in good standing through Completion of the Contract and all applicable warranty periods. Bids must be accompanied by a bidder's bond, cashier's check or certified check for TEN PERCENT (10%) of the amount of the bid. The bidder's bond or check shall be made payable to the Selma Unified School District and shall be given as a guarantee that the bidder will enter into a contract if awarded the work, and will be declared forfeited, paid to, or retained by the District as liquidated damages if the bidder refuses or neglects to enter into a contract on the terms of the accepted bid within ten (10) days after bidder's notification of District's acceptance of the bid. Bidders may not withdraw bids for a period of ninety (90) days after the date set for submittal of bids. Pursuant to the Contract Documents, the successful bidder will be required to furnish a Payment (Labor and Material) Bond in the amount of one hundred percent (100%) of the Contract Sum, and a Faithful Performance Bond in the amount of one hundred percent (100%) of the Contract Sum.
