The number of days within which, or the dates by which, the Work is to be completed and ready for final payment on or by 120 days after Notice To Proceed and is set forth in the Proposal and the Agreement. Liquidated Damages: As time is an essential element in this contract, all work shall be completed within the allotted time as specified in item nine (9) above. For each calendar day that any portion of the road construction shall remain uncompleted after the end of the time specified, the amount of One Hundred Ten Dollars per calendar day ($110.00/day) will be assessed. The amount is assessed not as a penalty, but as a predetermined and agreed liquidated damages to be used, in part, to pay any additional expenses incurred by the Owner as a result of being delayed.
