Each bid shall be presented under sealed cover and shall be accompanied by a certified check or bidder's bond, made payable to the Owner, in an amount not less than ten percent (10%) of the bid. The said check or bidder's bond shall be given as a guarantee that the successful bidder will execute the contract in conformity with the form of agreement contained within the contract documents and will furnish bonds and insurance policies as specified within ten (10) days after notification of the award of the Contract to the successful bidder. The contract documents that the successful bidder must submit within ten (10) days of notification of award include, but are not limited to, a payment or labor and materials bond in an amount of at least 100 percent of the amount payable by the terms of the project contract and that satisfies the requirements of California Civil Code Section 3248, and a performance bond in an amount of at least 100 percent of the amount payable by the terms of the contract. All project bonds must be executed by an admitted surety insurer in accordance with applicable law and acceptable to the Owner. The successful bidder will have two hundred (200) consecutive calendar days to substantially complete the project from the Notice to Proceed. Bidders shall develop and submit bids at their own expense. The Owner will not reimburse any costs associated with the development and submittal of any and all Bids . No bidder may withdraw its bid for a period of sixty (60) calendar days after the date set for the opening thereof. The Bidder shall guarantee the total bid price for a period of sixty (60) calendar days from the date of bid opening. The Owner reserves the sole right to reject any or all bids and to waive any informality in a bid.
