Reference Number 0000288783 Question Acceptance Deadline 2025/03/24 11:59:00 PM EDT Defect Fast Track Procedure In the Stage 2 Confederation Line Extension Project Agreement, the Defect Fast Track Procedure was identified as a concept to resolve disputes in a timely manner. In the case of a dispute between Project Co. (the maintainer for Stage 2) and DB Co (the DBF consortium for Stage 2), the Defect Fast Track Procedure is intended to assist with determining whether a problem constitutes a DBF Defect and/or the nature and extent of DB Co's Liability with respect to such DBF Defect. The Project Agreement calls for the identification and nomination of an Expert Organization that is wholly independent from each/all Parties and that has the capacity to provide Independent Experts who could render impartial decisions on matters of defect disputes. The Expert Organization is required to have the capacity to provide three (3) qualified individuals to be Independent Experts for each of the professional disciplines below and to provide qualified replacements if/as needed: Official bid documents must be obtained from www.merx.com and bid submissions must be done through the Merx platform.
