Project Specifications a. The loading and hauling of approximately 20,000 cubic yards of gravel, spread on municipal roads for the 2025 and 2026 seasons. b. Hauling maps shall be provided. c. The RM will do it's best to mark dust control sites but the onus of not gravelling over the sites is solely the contractor's responsibility. If a site is covered the office shall be notified immediately and the RM will work to remove it, if the site is not to the ratepayers and RM's satisfaction the cost of the dust control shall be deducted from the holdback. d. A 10% holdback will be enforced until the hauling requirements are met to the satisfaction of the RM. Tender Acceptance a. The Municipality reserves the right to refuse or accept any or all tenders, and the lowest tender not necessarily be accepted. b. Without limiting the generality of the foregoing, any tender may be rejected which is incomplete, obscure, or irregular. c. The Municipality reserves the right to cancel the acceptance of any tender at any time before execution of the contract by all parties without any liability against the Municipality. Late Tenders a. Tenders received after the date and time specified in Clause l.a will not be considered. Validity of Tenders A bidder may, without prejudice to himself, withdraw his tender at any time up to 9:00 am on the awarding day of the tenders. Commencement and Completion of Work a. Time will be of the essence of the Contract made with the successful bidder and the contractor will be required to comply strictly with the dates specified, subject to the terms of the contract b. Preference may be given to a early haul as long as the materials are available, all hauling to be completed by July 31 of each year. Contract a. If your signed tender is accepted by Council, the submitted tender will become a binding contract, with the instructions to form part of the contract. b. This tender and contract is for a 1 year term upon mutual agreement, with conditions to break the contract with 3 months written notice by either party.
