Connection of building 3 and 4 to the Provincetown sewer Each bid shall be accompanied by a Bid Deposit equal to five percent (5%) of the total bid price shown on the Bid Form. The Bid Deposit may be made in the form of a certified check or appropriate Bid Bond issued by a surety licensed by the Commonwealth of Massachusetts. The Bid Deposit of the three lowest bidders shall be held until the execution of the contract awarded pursuant to this IFB, all other Bid Deposits shall be returned within ten (10) business days of the opening of the bids. In the event that the successful bidder fails to execute the contract when presented by the Town as provided herein, the bidder's Bid Deposit shall be forfeited to the extent of the difference between its bid and the next lowest bid of a responsive and responsible bidder. The Town reserves the right to cancel this IFB, or to reject in whole or in part any and all bids, if it is determined to be in the best interests of the Town to do so. The award of the contract to the successful bidder is contingent upon an appropriation of sufficient funds. The Town reserves to itself the right to accept or reject any and all bids, or to allow or deny variations from these specifications. The contract will be awarded within sixty (60) days after the bid opening. The time for the award may be extended for up to forty-five (45) additional days by mutual agreement between the Town and the apparent lowest responsive and responsible bidder. All bid prices submitted in response to this IFB must remain firm for sixty (60) days following bid opening, and for any extension of the time for award of the contract as provided above.
