**As of September 03, 2025, the project was awarded to Midland Development & Construction LLC, but the awarded amount is not available.** The City of Derby, Connecticut is soliciting proposals ("Development Proposals") for development of its municipal parking garage (the "Municipal Parking Facility") located at 2 Thompson Place (the "Site") in the City of Derby, Connecticut (hereinafter, the "Thompson Place Development"). This solicitation is the first step in a process to select a preferred developer ("Preferred Developer") to undertake a mixed-use project on the Site. The Municipal Parking Facility is located at 2 Thompson Place at the intersection of Elizabeth Street in Derby and is currently owned by the City of Derby. A total area of approximately 0.85 acres is being offered for development. In making this solicitation, it is recognized that the Thompson Place Development represents a unique site open to redevelopment. The development opportunity at the Site is enhanced by its New Haven County location and its close proximity to major metropolitan centers and to Fairfield County, one of the wealthiest regions in the country. New York City is approximately an hour's drive south, while Boston is less than three hours north. A well-developed transportation system located in Derby serves as an important link to these markets and includes local bus systems and Connecticut Routes 34, 8 and 15 and proximity to both Interstate 95 and Interstate 84. The Site is directly accessible to Route 34, and convenient to Route 8 located within 1500 feet of the Site. The Derby Railroad Station, offering regular Metro-North service is located on the eastern edge of the Derby downtown business district and within a short walking distance of the Site. National and International air service is available at 6 airports within 2 hours drive. Thompson Place Development is in the center of the City of Derby's emerging downtown district. This strategic location, coupled with the financial support of the State of Connecticut and the City of Derby's steadily improving fiscal condition, has prompted significant public and private investment in Derby's downtown over the last few years. The City's business sector has been invigorated and is primed for growth. The redevelopment of the Municipal Parking Facility is a logical and key step in Derby's transformation into a 21st century city. The Municipal Parking Facility is located within the Central Design Development District ("CDD"). Proposers are encouraged to familiarize themselves with the City's Zoning Regulations, paying particular attention to permitted uses. Proposals should include a narrative description of any zoning compliance issues associated with the proposed use of the Site and what, if any, zoning permits and/or variances will be required. The City will give preference to proposals that accurately describe any zoning compliance issues and present a well-thought-out approach to resolution of those issues. The City contemplates that the acquisition will take the form of a sale or ground lease of the Site. The Municipal Parking Facility currently has approximately 430 parking spaces, a number of which parking spaces are currently leased (216). Copies of the existing and historic agreements for the lease, operation and/or use of parking spaces at the Municipal Parking Facility (hereinafter, the "Existing Agreements") will be made available for inspection. These Existing Agreements include without limitation agreements with i) the United States Post Office; ii) the State of Connecticut Judicial Branch; iii) TEAM; iv) BH Care, PCRC; v) Derby Manor a/k/a Sterling Rowe Apartments; and vi) Cohen & Thomas. The Site will be conveyed subject to the terms and conditions of the Existing Agreements. The Existing Agreements together with any other additional reports or materials, including environmental reports and materials, delivered by the City to any Proposer are collectively referred to herein as the "Property Documents." Proposer agrees that City shall be under no obligation to acquire or obtain for delivery to Proposer any of such Property Documents. City makes no warranty as to the accuracy or completeness of any of the foregoing or any other information or items which may be furnished from time to time to Proposer by the City, its employees, agents or independent contractors, including without limitation the Existing Agreements and the Property Documents. Proposals should include provisions for not less than 340 municipal parking spaces. Because the Municipal Parking Facility is located in the CDD where there is a need for public parking facilities, the successful Proposer will be required to agree to a parking easement in favor of the City. The Parking Easement will run with the land in perpetuity and be recorded on the Derby Land Records. The Parking Easement will provide for no less than 340 municipal parking spaces (the "Parking Spaces"). The Parking Easement shall include maintenance and repair standards and will permit the City to charge for the Parking Spaces. The successful Proposer will be expected to enter into a purchase and sale agreement, a ground lease, a development agreement and/or land disposition agreement (the "Agreement," whether one or more) in a form prepared by the City Attorney. The City reserves the right to establish deadlines and/or time limits for negotiations. The City will not provide financing. Questions Deadline: May 30, 2025
