** As of July 07, 2025 project has been awarded to National Metering Services, Inc. with an amount of $2,970,394.02.** PASSAIC VALLEY WATER COMMISSION PATERSON WATER METER REPLACEMENT PROGRAM This Contract is for the replacement of approximately 6,640 water meters and Radio Frequency Meter Interface Units (RFMIUs) in the Cities of Clifton, Paterson, and Prospect Park. Information and Instructions for Bidders, Specifications and other Contract Documents are available in electronic form by forwarding an e-mail request to lbresemann@pvwc.com. Each submission shall be provided on the standardized forms as supplied in the submission package and the said standardized forms shall not be modified or altered in any way. The Contractor shall submit any questions regarding the bid documents by May 27, 2025, at 3:00 p.m. to the project representative listed in the bid documents. Bidders shall comply with the requirements of the Local Public Contracts Law N.J.S.A. 40A:11-1 et. seq. as supplemented and amended; Mandatory Equal Opportunity as per N.J.A.C. 17:27-3.8 and N.J.S.A. 10:5-31, et. seq.; Ownership Disclosure Notice N.J.S.A. 52:25-24.2 in addition to other applicable State Laws. This contract or subcontract is expected to be funded in part with funds from the New Jersey Department of Environmental Protection and the New Jersey Environmental Infrastructure Trust and the successful bidder must comply with all the provision of N.J.A.C. 7:22-9.1 et seq. for the participation of small business enterprises owned and controlled by socially and economically disadvantaged individuals (SEDs). Neither the State of New Jersey, the New Jersey Environmental Infrastructure Trust nor any of their departments, agencies or employees is, or will be, a party to this contract or subcontract or any lower tier contract or subcontract. This contract or subcontract is subject to the provisions of N.J.A.C. 7:22, Financial Assistance Programs for Environmental Infrastructure Facilities, Subchapters-3, 4, 5, 9 and 10. In accordance with the provisions of N.J.S.A. 58:11B-26, N.J.A.C. 7:22-3.17(a)24 and 4.17(a)24, the contractor (subcontractor) shall comply with all of the provisions of N.J.A.C. 7:22-9.1 et. seq. Pursuant to N.J.S.A. 40A:11-21, a person bidding on a contract for the erection, alteration or repair of a public building, structure, facility or other improvement to real property, the total price of which exceeds $100,000, shall furnish a guarantee as provided for herein. A contracting unit may provide that a person bidding on any other contract, advertised in accordance with law, shall furnish a guarantee as provided for herein. The guarantee shall be payable to the contracting unit so that if the contract is awarded to the bidder, the bidder will enter into a contract therefor and will furnish any performance bond or other security required as a guarantee or indemnification. The guarantee shall be in the amount of 10% of the bid, but not in excess of $20,000.00, except as otherwise provided herein, and may be given, at the option of the bidder, by certified check, cashier's check or bid bond. In the event that any law or regulation of the United States imposes any condition upon the awarding of a monetary grant to any contracting unit, which condition requires the depositing of a guarantee in an amount other than 10% of the bid or in excess of $20,000.00 the provisions of this section shall not apply and the requirements of the law or regulation of the United States shall govern. Pursuant to N.J.A.C. 7:22-3.17(g): All applicable surety bonds required in connection with the advertisement and award of building contracts or subagreements must be written by a surety company listed on the Federal Treasury List (Department Circular 570-Surety Companies Acceptable on Federal Bonds), incorporated herein by reference. The successful bidder for the Contract shall be required to comply with the higher of the prevailing local minimum wage rates as determined by the New Jersey Department of Labor or the Federal Davis-Bacon Wage Rates. This project is expected to be funded in part by New Jersey Department of Environmental Protection (NJDEP) and New Jersey Environmental Infrastructure Trust (NJEIT). Neither the State of New Jersey, the NJEIT nor any of their departments, agencies or employees is, or will be, a party to this contract or subcontract. This contract or subcontract is subject to the provisions of N.J.A.C. 7:22-3,-4,-5,-9 and -10. All federal prevailing wage regulations as well as the Federal Labor Standards Provisions will apply. Attention is called to the fact that the contractor must ensure that employees and applicants for employment are not discriminated against because of their race, creed, color, sex or national origin and to the greatest extent possible, opportunities for training and employment shall be given to lower-income residents of the project area and that, when possible, contracts shall be awarded to business concerns owned by area residents. Small, Minority and Women's Business Enterprises are encouraged to submit bids. Bids for proposals in excess of $100,000 must be accompanied by a written Affirmative Action Plan. Bidders are required to comply with the requirements of P.L. 1975, c. 127. In accordance with the provisions of N.J.S.A. 58:11B-26, N.J.A.C. 7:22-3.17(a)24 and 4.17(a)24, the Contractor (subcontractor) shall comply with all the provisions of N.J.A.C. 7:22-9.1 for the participation of small business enterprises owned and controlled by socially and economically disadvantaged individuals (SEDs). The successful bidder for the project shall commit to the use of small business concerns owned and controlled by SEDs with a goal of ten percent (10%) of the work value under the contract. All contractors, including SED contractors, shall submit their own SED Utilization Plan to the NJDEP OEOPCA, with a copy to the Owner, within thirty (30) days of the contract award. The contractor's plan shall contain provisions to meet the specific SED Utilization requirements of the contract. The contractor's plan shall outline the entire project or contract work, the estimated time to complete the work, each significant segment of work on which SEDs will or may participate and a description of how SEDs will be contacted. The Contractor shall submit SED Participation Monthly Progress Reports (Form OEO-003) to the Project Compliance Officer and shall submit SED Participation Building Phase Quarterly Reports (Form OEO002) to the Project Compliance Officer and to the OEOPCA, in accordance with N.J.A.C. 7:22-9.12. N.J.A.C. 7:22-3.17(a)24, 4.17(a)24, 6.17(a)24 and 7:22A-2.4(a) provide that a goal of not less than 10 percent be established for the award of contracts to small business concerns owned and controlled by one or more socially and economically disadvantaged individuals. The goal of 10 percent applies to the total amount of all contracts for building, materials and equipment, or services (including planning, design and building related activities) for a construction project." The project sponsor has identified that the SED utilization goal for this project is: 10% The successful bidder must fulfill the SED utilization requirements by subcontracting portions or the work to SEDs; or establishing unrestricted bidding procedures to fulfill the SED utilization requirement for the project. This invitation to bid is on an unrestricted basis whereby the successful bidder must fulfill the SED utilization requirements. If the successful Bidder's Proposal does not meet the SED Utilization requirements, the successful bidder shall advertise and continue the search for SED participants for a minimum of 30 days after the Contract is awarded. Within the parameters established by the governing law (N.J.S.A. 40A:11-13.2), the Commission reserves the right to reject bids or to waive minor informalities or irregularities in the Proposals received and to award the contract to the lowest responsible bidder.
